New laws to improve the safety of workers and others when operating quad bikes in Queensland workplaces have commenced.

Helmets
All individuals, including passengers, must wear securely fitted and fastened helmets while operating quad bikes.

Age restriction
To ride a quad bike, operators must be at least 16 years of age, or the minimum age recommended by the manufacturer. This means that children under 16 are not allowed on adult-sized quad bikes and can only ride on age-appropriate quad bikes in workplaces.

Passenger restriction
Quad bikes cannot carry passengers, unless the vehicle is explicitly designed for passenger use, and the passenger is at least 16 years old or meets the minimum age recommended by the quad bike's manufacturer.
Penalties apply for non-compliance.

The regulation does not apply to side-by-side vehicles or quad bikes used outside of a workplace.

Transitional arrangements - Hearing protection
From 31 March 2024, regulation 58 of the Work Health and Safety (General) Regulations 2022 will come into effect requiring PCBUs to provide audiometric testing for workers who are frequently required to use personal protective equipment (hearing protection) to protect them from the risk of noise induced hearing loss where their exposure to noise in the workplace exceeds the exposure standard.
Accordingly, a PCBU must provide audiometric testing for a worker within three months of the worker commencing work where hearing protection is required and regularly follow up at least every two years.

Occupational noise-induced hearing loss (NIHL) is a major compensable industrial disease in Australia and entails substantial economic costs. Exposure to excessive noise also entails largely unrecognised costs to organisations by way of increased employee turnover and absenteeism, lowered performance, and possible contribution to accidents. As well as the economic cost for employers, NIHL imposes a severe burden on health and social services and the economy as a whole.

WHS Form 115 Hearing Conservation and Noise Management Policy and Procedure

The purpose of the policy is to prevent noise-induced hearing loss and other detrimental effects of exposure to excessive noise in the work environment.

To protect employees who are exposed to high noise levels and ensure, so far as is reasonably practicable, that the potential for exposure to noise.
To:

Minimise occupational noise-induced hearing loss and tinnitus by an approach that emphasises the reduction of noise levels at work by engineering noise control measures.
Promote the recognition and understanding of the effects of exposure to noise.
Promote the adoption of a systematic approach to reducing and managing exposure to excessive noise.
promote implementation through consultation between employers, employees and/or employee representatives.
