📅 Do you know the different types of leave employees are entitled to in Australia?

Under the Fair Work Act, employees may be entitled to several different categories of leave, including:

✔️ Annual Leave – Paid time off for rest and recreation
✔️ Personal / Carer’s Leave – When employees are sick or caring for an unwell or injured family member 🤒
✔️ Compassionate Leave – When a close family member passes away or suffers a life-threatening illness
✔️ Parental Leave – For the birth or adoption of a child 👶
✔️ Community Service Leave – Including emergency services and jury duty 🚒⚖️

In addition, employees may also be entitled to Long Service Leave, which is governed by state legislation rather than the Fair Work Act.

Because different rules apply depending on the state or territory, understanding long service leave obligations can sometimes be confusing 🔎.

❓ Is your employee award-covered… or award-free?

Many people assume every employee in Australia is covered by a modern award or enterprise agreement — but that’s not always the case.

Some roles fall outside award coverage and are classified as award or agreement-free employees.

This often includes senior roles such as managers, executives and CEOs.
However, this is not always the case, and many managerial roles are still covered by an award depending on the duties performed and the industry. It’s always prudent to check carefully rather than assume 🔎.

Importantly, award-free doesn’t mean rule-free ⚖️.

Employers must still comply with:
✔️ National Employment Standards (NES)
✔️ National Minimum Wage (where applicable)
