Fair Work Friday

A $362,500 settlement. A signed release. An ongoing legal proceeding.

This week's case is a timely reminder that settling one claim doesn't automatically settle every claim arising from the same workplace events.

The employee had already commenced a separate discrimination proceeding, and because the release was drafted around a workers' compensation damages claim, VCAT found that the discrimination case could continue.

The lesson? If your intention is to achieve a complete and final resolution, your release documents need to clearly identify every claim, every jurisdiction and every party being released.

A settlement payment doesn't create finality. A well-drafted release does.
