Do you use a discretionary trust for your business, investments or family assets?

New draft legislation has provided more detail on the Federal Government’s proposed 30% minimum tax on discretionary trusts, expected to apply from 1 July 2028.

Under the proposal, relevant trust income would generally be taxed at a minimum rate of 30%, potentially changing the tax benefits of distributing income to beneficiaries on lower tax rates or using corporate beneficiaries.

The legislation is still in draft form and may change, so there is no need to restructure now. However, if you use a discretionary trust, it’s worth understanding what the proposed changes could mean for you.
