IMPORTANT STUDENT VISA UPDATE
Significant changes to Australia’s Student visa and international student transfer rules take effect from 2 October 2026.

🔄 Student transfers
The transfer restriction for non-school international students temporarily increases from 6 months to 12 months from 2 October 2026 to 30 June 2027. It is scheduled to return to 6 months from 1 July 2027. School-sector students remain subject to the 6-month rule.

✈️ Onshore Student visa applications
Current Student visa holders will generally need to apply for another Student visa from outside Australia, unless they fall within a specified exception.

⚠️ Other visa holders affected
Holders of certain visas, including 485, 482, 407, 408, 417, 400, 403, 600, 601, 602, 651, 457, 771, 988 and 995, may also be required to apply for a Student visa from outside Australia.

🎓 Exceptions apply
Certain students may still be eligible to apply onshore, including some doctoral students, students completing their studies, students affected by provider default, qualifying course progression cases, and certain family members.

📚 Course progression matters
Students moving to another course need to consider the AQF level, course type and education provider requirements. Not every course change will qualify for an onshore Student visa application.

📌 Before changing your course or provider:
Check your current visa, principal course, study period, transfer eligibility and whether an exception applies.

Student Visa Changes – Who May Be Affected?

From 2 October 2026, new rules affect applications for another Student visa while in Australia.

Some students who may be affected include those who:

🔹 Changed education provider
🔹 Changed to the same or lower AQF-level course
🔹 Are moving to a lower-level course
🔹 Have a Student visa expiring before their studies are completed
🔹 Are progressing to a higher AQF-level course
🔹 Are a Student visa dependant wanting to become the primary applicant
🔹 Plan to bring family members later
🔹 Need more than 12 months to complete their studies
🔹 Need up to 12 months after the original course end date and continue with the same provider — a specific exemption may apply

⚠️ Having study remaining does not automatically mean you can apply onshore.

If your Student visa is expiring, check your options early.

🇦🇺 Student Visa Expiring Before Your Studies Are Finished?

From 2 October 2026, new rules affect applications for another Student visa.

🔹 Current Student visa holders generally cannot apply for another Student visa while in Australia, unless a specific exemption applies.

🔹 12-month completion exemption: You may be able to apply in Australia if you need up to 12 months after the original course end date to complete your studies and you continue with the same education provider.

🔹 Other exemptions may apply to certain:

* PhD/doctoral students
* DFAT or Defence-sponsored students
* School students
* Students progressing to a higher AQF-level course
* Students affected by provider default

🔹 If no exemption applies: you generally need to leave Australia before lodging your Student visa application.

🔹 You must be outside Australia when the new Student visa is granted. You may be able to return to Australia on another valid visa while the application is being processed.

🔹 An offshore Student visa application does not provide a Bridging visa.

🔹 The new rules also affect family members and subsequent entrants.

⚠️ If your Student visa is expiring soon, check your options early.

New No Further Stay (NFS) Condition Rule – Impact on Onshore Aged Parent or Aged Dependent Relative Visas

Today’s announcement to impose a compulsory No Further Stay (NFS) condition on future Visitor visas could significantly affect future onshore applications for:

• 804 – Aged Parent
• 864/884 – Contributory Aged Parent
• 838 – Aged Dependent Relative

If implemented as announced, future Visitor visa holders with NFS would generally be unable to lodge these visas while in Australia, effectively restricting the common Visitor → Onshore Aged Parent or Agee Dependent pathway.

The visas themselves are not being abolished and may remain available to eligible applicants holding other visas without NFS or where an NFS waiver is available.

The final impact will depend on the implementing regulations and transitional arrangements.

• Net Overseas Migration लाई करिब 300,000 बाट 2027–28 सम्म 225,000 मा झार्ने लक्ष्य।
• अधिकांश international students ले spouse/children ल्याउन नपाउने, तर PhD तथा केही विशेष category/देशका लागि अपवाद रहने।
• Visitor Visa मा “No Further Stay” condition व्यापक रूपमा लागू गरी onshore visa hopping नियन्त्रण गर्ने।
• Working Holiday Visa मा कडाइ—दोस्रो वर्षका लागि 45,000 cap र तेस्रो वर्षका लागि 5,000 ballot। UK नागरिकमा trade agreement का कारण फरक व्यवस्था।
• 77,000 visa overstayers माथि compliance कडा गर्ने—थप 100 compliance officers र 250 detention beds को व्यवस्था।
• Skilled migration processing मा healthcare, construction, education, agriculture लगायत आवश्यक sectors लाई प्राथमिकता दिने।
• पहिले नै Australia मा रहेका student families लाई नयाँ family restriction ले असर नगर्ने; मुख्यतः future visas मा लागू हुने।

समग्रमा हेर्दा—ठूलो संरचनात्मक परिवर्तनभन्दा temporary migration, dependants, visa hopping र overstayers माथि कडाइ केन्द्रित देखिन्छ।

🇦🇺 Australian Student Visa Refusals Hit a 10-Year High

The latest figures are a strong reminder: an Australian student visa is no longer just about getting an offer letter and submitting an application.

🎉 SUCCESS STORY – FROM VISITOR VISA TO STUDENT VISA GRANT! 🎉

What a journey and what an incredible outcome!

Our client initially arrived in Australia on a Visitor Visa (Subclass 600) with the intention of exploring study opportunities. After deciding to pursue further education, the client lodged a Student (Subclass 500) visa application, which was initially refused by the Department of Home Affairs due to concerns raised in the decision.
