Reading a recent Courier Mail article this morning about the growing use of AI in recruitment got us thinking.

AI is a powerful tool and will undoubtedly play a major role in the future of hiring. But when it's used to screen applicants before a human reviews their resume, are we potentially overlooking great candidates simply because a computer says "no"?

As part our recruitment process, we are proud to say that every resume is reviewed by a real person. Before we recommend candidates to our clients or place them on our shortlist, we take the time to assess their skills, experience, and potential ourselves.

An employee with 17 years' service at ABC Tissue was dismissed after an altercation with a colleague. While the Fair Work Commission found that the employer had a valid reason for dismissal, it also identified a number of procedural shortcomings, including not using an accredited translator, not clearly warning the employee that dismissal was being considered, and not providing CCTV footage during the disciplinary process.

This is where a lot of employers get it wrong. Suspected theft? You still need procedural fairness. Drug and alcohol breaches? You still need procedural fairness. Serious misconduct? You still need procedural fairness.

Employees should be given a genuine opportunity to understand the allegations against them, respond to those allegations, and participate meaningfully in the process.

Section 387 of the Fair Work Act requires the Fair Work Commission to consider not only whether there was a valid reason for dismissal, but also whether the employee was afforded procedural fairness throughout the process. This case highlights that both elements matter.

Ultimately, the Commission found there was a valid reason for dismissal and that the few procedural shortcomings would not have changed the outcome.

A good reminder that while having a valid reason for dismissal is critical, employers should also ensure their disciplinary processes are fair, transparent and well documented.

Unfair dismissal even though the Employee threatened the boss ...πŸ€”

The Fair Work Commission recently found that an employee was unfairly dismissed, despite the employer having a valid reason for termination.

This case is a timely reminder that having a valid reason to dismiss does not automatically make a dismissal fair.

The employee's conduct included making comments such as:

πŸ—¨οΈ"I don't have to listen to you. This is not a dictatorship."

πŸ—¨οΈ "I should have f***ing smashed you years ago."

πŸ—¨οΈ "I'll smash his head in. I'll kick that f***ing dog's head in."

πŸ—¨οΈ And somewhat ironically, referring to someone else as "a disrespectful c***, he swears at everyone."

While the Commission found the employer's dismissal process lacked procedural fairness, it also found the employee's own conduct significantly contributed to the dismissal.

As a result:

βœ… Unfair dismissal was established.

❌ No compensation was awarded.

❌ No reinstatement was ordered.

The Employer is extremely lucky as most unfair dismissal cases result in compensation ... so avoid the risk.
