In Australia 40°F is 4.44°C - with commercial fridges only those rated to operate between 0-5°C are actually FOOD SAFE, as per Australian & New Zealand MEPS legislation. These are for "high-risk" foods such as dairy, meat, poultry, eggs, seafood and most processed foods, especially those containing any these "high-risk" foods.

Are you checking your steps in the fridge?
💧 – wash your hands for 20 seconds before entering.
↔ – store raw meats in containers to prevent juices from leaking.
❄– make sure your fridge is set at or below 40°F.

Glass condensation could be a sign of poor glass technology. Drinks fridges (usually rated 0-10°C or 2-8°C) are not suitable for cold dependant food as per MEPS Legislation for Aust/NZ. Businesses keeping meat or dairy in them should know better, risking not only their customers health, but also their business reputation. Cheap display fridges (usually power inefficient) often do not have the glass technology required to prevent condensation forming. Check out this fridge (clearly an ex-drinks fridge) with an internal temperature of 6.7°C (sat the same temperature for more than an hour of monitoring). This fridge is in well air-conditioned shopping centre where the temperature is usually 24°C, so it should be performing better. There is also the factor of where the internal fridge temperature sensor is located, some internal temperatures could actually be a lot higher.
