At Domatic Access, we regularly receive requests asking whether Performance Solutions can be used to *avoid* providing access under the NCC.
The short answer is, no – a Performance Solution is not a free pass or exemption. It’s simply an alternative way to meet the same Performance Requirements as the Deemed-to-Satisfy provisions.
There are only very limited situations where access might be *unreasonable or unsafe* for a person who lives with a disability to enter – for example, certain hazardous plant rooms that are restricted to trained maintenance staff and not normally occupied. Even then, any exemption needs to be clearly justified, documented, and still achieve the intent of the NCC.
