I've been playing with AI and thought you'd be interested in this example. This is an avatar of me - took under 4 minutes to make - which could do with a bit of editing and a few less gestures, incorporated with an upload of Our Services script. Not bad for a first attempt. Must say the Italian version looks better as the gestures seem entirely appropriate.

How Material is NALE?

There has been significant comment on the government’s proposed treatment of general non-arm’s expenditure in SMSFs but what is a general expense.

General expenses include actuarial costs, accountancy fees, audit fees, costs in connection with the calculation and payment of benefits (not the benefit itself), investment adviser fees & other administrative costs incurred in managing the fund.

The expenditure may be of a revenue or capital nature or deductible under a specific provision so can include fund establishment and deed amendment costs.

Any material instance must be identified by the SMSF’s auditor. This poses a conundrum as only those obvious instances, e.g. preparing the fund accounts for $0, will be necessarily caught given that it is not the auditor’s responsibility to determine the market value of a service. The ATO have a similar problem which is probably why their compliance resources will only be directed “towards ascertaining whether the parties have made a reasonable attempt to determine an arm’s length expenditure amount for services provided to the fund”.

Accordingly, where the SMSF’s documentation confirms that the parties have made a ‘reasonable’ attempt to determine the expenditure, the ATO won’t try and determine whether those expenses are, in fact, arm’s length expenses. Clearly, silly numbers like the $0 example above, will fail but, if the amount is “reasonable” and documents show that both parties have made a reasonable attempt to determine that the item is at arm’s length, then the auditors will have no reason to raise the issue.

Hopefully trustees have not left their contributions and pension payments to the last minute as there is a likelihood that they may not be completed by 30th June if electronically initiated this week. As a solution, SMSFs can find a promissory note useful to back a bank transfer that might miss the 30 June deadline.

A contribution can be made by supplying the fund trustees with a promissory note dated no later than 30th June and cashed in the first week of July. Pensions may also be paid by the fund issuing a promissory note to the member dated no later than 30 June. To be acceptable, the fund will need to have sufficient cash to cover it on issue and it must be cashed within a few days.

Contributions may also be made in specie by supplying the fund with fully completed transfer documents no later than 30 June. Be careful though as a transfer from an entity, other than the member or spouse, will be a concessional contribution.

In specie payments to members must be avoided for pension purposes as these are lump sum drawdowns so do not count as pensions.
