The Victorian Government is pushing ahead with Australian first laws that would give employees the right to work from home at least two days a week where their role can be reasonably performed remotely.

Premier Jacinta Allan has reinforced that this right will apply regardless of workplace size, extending protections to small business employees.

While some business groups have criticised the proposal as government overreach, the policy aims to support families, reduce congestion, and modernise workplace expectations.

Many business leaders are calling it unworkable and a vote grab. With industrial relations in the federal domain, former Fair Work Commission Vice President Graeme Watson rates the prospects of successfully implementing the laws a 3 out of 10.

Legislation is expected to be introduced later this year, following further consultation with employers and industry.

In Victoria, Monday 9th March is Labour Day. If you have employees rostered to work that day, they may be eligible for public holiday loading on top of their base rate of pay. Some employees may also be eligible to be paid for minimum shift hours.

Full-time and part-time employees who take the public holiday off should be paid their base rate of pay for the hours they otherwise would have worked.

Employees are only eligible to be paid for the public holiday if the public holiday falls on a day that they normally work.

If you are unsure, check your modern award(s), employment agreement(s) or the National Employment Standards to avoid payroll errors and potential underpayment claims. The Fair Work Ombudsman has a Pay and Conditions Tool which can help you calculate penalty rates.
