This has been a really interesting, complex and somewhat difficult case to review from a HR perspective! It is longer than our usual reviews, but is so jam packed with learnings. It was worth delving into the detailed evidence as it provided a very real picture of the conduct that was likely occurring in the workplace. Despite this, the dismissed employee was reinstated. Don’t miss this review, it has something for even the seasoned HR professional.

This is a very interesting case. It certainly sets a much higher bar for employers in terms of managing psychosocial hazards associated with redundancy processes. Although I suspect there is a lot more going on behind the scenes that we don't know about as it is a relatively unprecedented response from SafeWork NSW. Definitely one to watch!
