Further support for Temporary Graduate Visa holders and international students

Temporary Graduate (subclass 485) visa holders who have been unable to travel to Australia as a result of COVID-19 international border restrictions will be able to apply for a replacement visa. This will allow current and former Temporary Graduate (subclass 485) visa holders whose visas expired on or after 1 February 2020 to re-apply for a new subclass 485 visa of the same duration as their original visa.
Additionally, the Morrison Government will increase the length of stay on the Temporary Graduate visa from two to three years for Masters by coursework graduates, matching that of Masters by research graduates. Vocational Education and Training (VET) sector graduates will also receive a two year Temporary Graduate visa.
The new visa settings will also extend existing measures for students and temporary graduates to recognise time spent offshore studying online to count towards qualifying for a temporary graduate visa.

Tourism and Hospitality added to critical work sectors - Subclass 408 and student work rights

Tourism and hospitality has been added to the critical sectors of agriculture, food processing, health care, aged care, disability care and child care for eligibility for the Subclass 408 COVID-19 Pandemic Event visa. Temporary visa holders employed in the tourism and hospitality sector are now able to access this SC 408 stream for a period of 12 months.

Temporary visa holders working in, or intending to work in, tourism and hospitality will be able to apply for the SC 408 COVID-19 Visa up to 90 days before their existing visa expires and then remain in Australia for up to 12 additional months.

Student visa work rights
The previous 40 hour fortnightly limit applied during study periods will not be enforced for student visa holders who are working in the tourism and hospitality industry.

The Department is taking a flexible approach to students working beyond the usual work limitations in the following industries:

employed in the health sector, enrolled in a health related course (such as nursing or medicine) and are directed by a health official to assist in the effort against COVID‑19
employed in aged care by an Approved Provider or Commonwealth-funded aged care service provider before 8 September 2020
employed by a registered National Disability Insurance Scheme provider before 23 April 2020
employed in the agriculture sector
employed in the tourism and hospitality sector

COVID-19 Concessions for Subclasses 887, 888, 188, 790 and 485

Migration Amendment Regulation 2020 to ensure that temporary and provisional visa holders, including individuals who are on a pathway to permanent residence, are not disadvantaged by circumstances beyond their control, including border closures, restrictions imposed on businesses and the general economic downturn related to COVID-19. The amendments provide concessions to visa requirements and conditions where the impact of COVID-19 would otherwise prevent or disrupt visa holders and applicants from meeting them. Good News - Priority Migration Skilled Occupation List (PMSOL) announced

A new priority skills list and strengthened labour market testing will allow small numbers of sponsored skilled workers to return to Australia to fill urgent skills needs in critical sectors, helping to create Australian jobs and rebuild Australia’s economy.

The 17 occupations on the Priority Migration Skilled Occupation List (PMSOL) were based on advice from the National Skills Commission and consultation with relevant Commonwealth agencies and will be reviewed regularly.

“These occupations in the health care, construction and IT sectors will supercharge both our health and economic response to COVID-19.
“Visa holders, who have been sponsored by an Australia business in a PMSOL occupation can request an exemption from Australia’s travel restrictions, but will be subject to a strict 14 days quarantine on arrival at their own expense.”

Immigration South Australia Update

The Commonwealth Department of Home Affairs has provided a limited number of skilled and business visa nomination places to the Government of South Australia up until the Federal Budget is delivered on 6 October 2020.

Skilled migration

The state’s allocation of interim 491 and 190 visa nominations are intended to support and prioritise South Australia’s economic recovery and public health response. Prospective applicants will be able to lodge an Expression of Interest (EOI) through the Department of Home Affairs SkillSelect system.

An invitation to submit an online application for state-nomination will be sent to prospective applicants with EOIs that meet Commonwealth and South Australian priorities. The Government of South Australia will publish state nomination requirements on 27 August 2020. From 31 August, South Australia will commence reviewing EOIs and sending invitations to submit an online application.

Business migration

The state’s allocation of interim 188 and 132 visa nominations are intended to support the outcomes of its Business Innovation & Investment Program:

High quality business owners and entrepreneurs have created genuine and sustainable business opportunities in South Australia that benefits the State’s economy, local businesses and the workforce.
The Government of South Australia will publish state nomination requirements on 27 August 2020. From 7 September, South Australia will commence reviewing Intention to Apply submissions and sending invitations to submit an online application.

AFP police certificates - evidence of identity during COVID

AFP Criminal Records requires 100 points of evidence to apply for a police check. During the COVID-19 pandemic, where applicants cannot obtain sufficient evidentiary documents, the AFP will accept a visa grant notice as 70 points of evidence.

The visa grant notice should be uploaded under the full Birth Certificate or Australian Citizenship Certificate tab.

Subclass 485 - English language testing

The Department of Home Affairs will be allowing additional time for Temporary Graduate 485 applicants to provide results for English language testing where COVID-19 has disrupted access to services.

For Time of Application requirements to be met, COVID affected applicants must provide, at time of lodgement, evidence they have an appointment booked for a English language test, or provide evidence that are unable to book a test where the centre is closed.

The requirement must still be met in full, that is, applicants must provide evidence they have sat and achieved the appropriate score in an English language test in order for their Temporary Graduate Visas to be granted. Please note the English language test must be administered by a Departmentally accredited provider. Currently, online or home edition test results are not acceptable forms of evidence.
