🚛 NHVR Intensifies Focus on Sham Contracting & High-Risk Operators

The National Heavy Vehicle Regulator (NHVR) has announced a renewed crackdown on high-risk transport operators, while also increasing focus on sham contracting practices across the road transport sector.

According to the NHVR:
• 21 operators have been identified as presenting unacceptable safety risks
• Multiple operators have lost accreditation or are under review
• Prohibition notices have already been issued to several businesses following intelligence-led investigations

What is sham contracting?
Sham contracting occurs when workers are incorrectly classified as independent contractors instead of employees — often to avoid obligations such as:

• Superannuation
• Leave entitlements
• Workers compensation
• Payroll obligations

Regulators and industry groups are increasingly linking sham contracting to:
⚠️ Safety risks
⚠️ Fatigue pressures
⚠️ Poor maintenance practices
⚠️ Unsustainable pricing models
⚠️ Unfair competition across the supply chain

This is becoming a major focus area across transport, logistics, and supply chain operations — with the NHVR, Fair Work Ombudsman, ATO, and other agencies now working together more closely than ever before.

🚨 Did You Know? Australia Maintains a Formal List of “Listed Human Diseases” Under Biosecurity Legislation.

DAFF has released IIAN 79-2026 advising that Andes Virus infection (Orthohantavirus andesense) has now been added as a listed human disease by the Australian Centre for Disease Control.

As a result:
• The Biosecurity (Listed Human Diseases) Determination 2016 has been superseded
• The new Biosecurity (Listed Human Diseases) Determination 2026 now applies
• Existing import permits referencing the 2016 determination may be impacted

This change may affect the importation of:
🧪 Microorganisms
🧬 Genetic material
🧫 Test kits
🩸 Infected human or animal tissues and fluids
🔬 Scientific and laboratory materials

DAFF has advised that both standard and non-standard permits may require review or amendment, with impacted permit holders to be contacted directly.

It’s a strong reminder that biosecurity compliance extends far beyond traditional cargo and can impact highly specialised scientific and research imports.

🚨 IEEPA Tariffs Ruled Unlawful – What It Means for Your Shipments

On 20 February 2026, the United States Supreme Court ruled that tariffs issued under the International Emergency Economic Powers Act (IEEPA) are unlawful.

So… what does this actually mean in practice?

👉 Key points:

IEEPA tariffs stopped being collected on U.S. imports from 24 February 2026 (12:00 a.m. EST).

This change follows guidance from U.S. Customs and Border Protection:
⚠️ No other tariffs or duties are affected by this ruling.

👉 What about refunds?

CBP is launching its refund system (CAPE) via the ACE Portal from 20 April 2026.

For shipments where brokers (like FedEx) handled clearance, refund claims will be submitted directly
💰 If refunds are issued by CBP, they will be passed back to the original payer (importer/shipper).

👉 Important reminder:
At the time of import, brokers and carriers are legally required to collect duties based on the regulations in force at that moment — even if those rules later change.

💡 What should importers be doing now?

1. Review past U.S. shipments where IEEPA tariffs were applied.
2. Confirm who acted as broker on those entries
Keep an eye on communications around refund processing.

At the moment, this is a developing space, and timelines will depend on how quickly CBP processes claims.

BIOSECURITY ALERT: Greece Loses FMD-Free Status

If you’re importing goods linked to animal products from Greece — this is one you cannot ignore.

Following a confirmed outbreak of Foot-and-Mouth Disease (FMD), Australia has removed Greece from the FMD-free country list (effective 15 February 2026).

Who does this impact?
Importers and brokers dealing with goods derived from FMD-susceptible species — including cattle, sheep, pigs, deer and camelids.

What goods are affected?
This is broad and goes beyond what many expect:

👉 Dairy (including cheese)
👉 Meat and personal food imports
👉 Animal casings
👉 Pet food and stock feed
👉 Veterinary therapeutics
👉 Reproductive material
👉 Laboratory goods (yes — even test kits and samples)

Important: Cheese is NOT banned — but heavily controlled
✔️ Requires a valid import permit
✔️ Must meet strict ripening conditions (30–120 days + pH requirements)

What about goods already in transit?
⚠️ Pre-15 Feb 2026: May be released (with evidence)
⚠️ Post-15 Feb 2026: At risk of export or destruction

This is where we’re seeing real pressure — cargo already on the water now sitting in uncertainty.

Biosecurity settings can shift quickly — and when they do, the consequences are immediate.
