The Mid-Autumn Festival is one of the most significant celebrations across many South Asian cultures, symbolising reunion, gratitude and prosperity, and providing an opportunity for family, friends and communities to come together.

Last week, we were delighted to welcome clients, colleagues and members of Sydney's business community to celebrate this important cultural festival. The evening provided a wonderful opportunity to connect, share experiences and strengthen relationships while recognising the rich diversity that helps shape our community.

The tax treatment when you sell a property isn't determined at the time of sale, it's determined by what you intended when you acquired it, and what happened in between.

Properties held as long-term investments are typically treated as capital assets. Properties acquired with the intention to develop and sell are typically on revenue account. The problem is that intentions aren't always clear from the outset, and they can legitimately change over time, a long-held investment property that pivots into a development or profit-making scheme may no longer be on capital account, regardless of how long it was held.

The difference in tax treatment between the two isn't marginal. Getting advice after the sale has limited value.

Adam Crowley explains how the ATO approaches this distinction and what developers and investors need to consider before they dispose.
