Councils are collapsing everywhere because they are absolute cesspits of lies graft and greed.

The Carnarvon Shire Council has been left without a quorum, following the resignation of six councillors.

Five councillors tendered their resignation over the weekend and today, following Shire President Eddie Smith's shock resignation on Friday.

Shire of Carnarvon CEO, Mandy Dexter, said in a statement the council was currently unable to hold valid meetings or make decisions that require a formal resolution of council.

"The Shire understands that this is a significant and unusual situation, and that the community will have questions about what has occurred and what happens next," the statement said.

"The Shire is now working with the Department to confirm the appropriate process and next steps."

Ms Dexter assured the community that the Shire remained operational under the leadership of the Chief Executive Officer and Shire staff.

"Matters that require a formal Council decision will be managed in accordance with advice from the Minister and the Department.

"The Shire will not be commenting on the individual reasons for elected member resignations at this time."

VicPol malicious prosecution claim ….

In my Supreme Court claim for malicious prosecution, I have set out how the conduct will be tested through evidence and discovery.

Here is a simplified version of the pleaded case:

Investigating Officer :
- Continued a criminal charge despite lack of evidence
- Maintained prosecution after the underlying application was struck out
- Engaged in coercive and misleading conduct

Allegation: knowledge the charge could not be sustained.

Supervising Officers :
- Failed to investigate exculpatory complaints
- Allowed prosecution to continue without proper review

Allegation: wilful blindness / failure to intervene.

Professional Standards Command :
- Received detailed complaints and supporting material
- Referred matters back to the same officers
- Took no effective action

Allegation: institutional “closing of ranks”.

Prosecution / Senior Officers :
- Sought repeated adjournments
- Prolonged proceedings over an extended period

Allegation: abuse of process and improper continuation.

System-Level Conduct :
- Proceedings continued despite lack of evidentiary foundation
- Complaints ignored across multiple levels
- Delays caused significant financial and personal harm

Allegation: misuse of the criminal process for an improper purpose.

This proceeding concerns allegations of malicious prosecution, abuse of process, and misuse of public power by Victoria Police.

The claim sets out that the prosecution was continued for over a year after the underlying factual and legal basis had ceased to exist, and was ultimately dismissed on its merits.

Given this involves the use of publicly-funded police powers, I consider it to be a matter of public interest that the documents are accessible.

The reference to the Major Torts List in the claim was included after the Registrar told me to change it from the General to Personal Injuries List. I refused because this is not a Personal Injuries claim so it would have been struck out at the first hearing. (Not my first rodeo).

Discovery will be sought next. That will be very interesting indeed….

(It’s no coincidence that the landlord involved in the Ray White claim is also an ex Police Officer and they still mix in the same Benalla circles. It is also no coincidence that the criminal charge came at the same time the property dispute escalated to eviction …. No-one can convince me they don’t stick together).
