We’re looking forward to being part of the ARITA Queensland Division Conference in Brisbane tomorrow, bringing together some of Queensland’s leading insolvency professionals for an afternoon of discussion, insight and connection.

Stacy Miller will be presenting on s 447A of the Corporations Act — a provision that continues to play an important role in the practical application of Australia’s insolvency laws.

It is a real honour to be included among such an impressive group of Queensland insolvency practitioners and professionals, and to have the opportunity to contribute to the conversation on the issues shaping our profession and the turnaround industry.

We look forward to seeing colleagues and friends at the conference tomorrow.

Last Thursday, Cronin Miller Litigation was proud to join Motherhood Village in celebrating the official opening of its new home at Varsity Lakes.

As a Gold Coast law firm and business leaders in the community, we believe strongly in supporting organisations that make a meaningful difference in our community, and Motherhood Village is exactly that.

Derek and Stacy attended the celebration, with Stacy in her capacity as Board Chair of Motherhood Village. We are particularly proud that Stacy has taken on this role and that Cronin Miller Litigation can support her, the Board, the Peer Leaders and volunteers in the important work they are doing to ensure mothers and families across the Gold Coast have access to connection, support and a safe place to ask for help.

The importance of this work has shockingly come into high visibility in recent months with the tragic events in South Australia leading to the death of a 36 year old mum and her two children, and the Lindsay Clancy trial overseas highlighting the devastating consequences that can occur when severe postpartum mental health challenges go unrecognised or unsupported. While those cases represent the most extreme circumstances, they remind us why early connection, accessible support and removing the stigma around maternal mental health matter so much.

Congratulations to Tracey Tyley, CEO and Founder, the Motherhood Village Board, Peer Leaders, volunteers and everyone who has contributed to bringing this new space to life.

So great to see so many of the CML network at the event as well, beautifully captured by the amazing celeste.riane.photography and novasoma photography, reflecting what an amazing connected community we have here on the Gold Coast

In a society where sharing everything on social media is the norm, are we becoming less cognisant of the risks and potential enormous financial consequence of unintentionally (or otherwise) defaming someone online?

Partner, Stacy Miller gave a recent interview to 10 News on the risk of business owners sharing CCTV footage online with identifying features of alleged shoplifters before a properly completed police investigation and charges being laid.

The awards for damages, including aggravated damages, in Queensland, together with the very real cost of litigation means the desire to post online and name and shame could just come with a seven figure price tag!

Testamentary trusts are a powerful estate planning tool that can provide both flexibility and tax efficiency for beneficiaries.

One of the key advantages is the potential for tax-effective distributions to minor children. In many cases, income distributed through a testamentary trust may be taxed at adult marginal rates, potentially resulting in significant tax savings.

These funds can assist with ongoing expenses such as education, living costs, sport and extracurricular activities.

However, whether a testamentary trust is appropriate will depend on your personal circumstances and broader estate planning objectives.

When financial pressure builds, directors are often required to make difficult decisions - quickly.

Safe harbour is frequently seen as a safeguard. In reality, its availability depends on how directors respond in practice.

Derek Cronin will once again be participating in the Vinnies CEO Sleepout this year, spending a night outdoors to help raise funds and awareness for homelessness in our community.

This will be Derek’s 4th CEO Sleepout, with over $20,000 raised across previous years in support of this important cause.

This year, Derek is aiming to raise $8,000 for St Vincent de Paul to help support Australians experiencing homelessness.

Any contribution, big or small, is greatly appreciated. 🙏
