Could Victoria be leading the next evolution of flexible work in Australia?

Victoria could become the first Australian jurisdiction to legislate a right to work from home, with the Equal Opportunity Amendment (Work from Home) Bill 2026 currently before Parliament.

The proposed Equal Opportunity Amendment (Work from Home) Bill would allow eligible employees to work remotely up to two days per week where their role can reasonably be performed from home.

If passed in its current form, the legislation would mark a significant shift in workplace flexibility, creating a presumption in favour of working from home for eligible employees where it is reasonable to do so. Employers would need to demonstrate genuine operational reasons to refuse a request.

The changes are expected to take effect from 1 September 2026 for most employers, and 1 July 2027 for small businesses.

What should employers be considering now?

✅ Identify roles that can be performed remotely
✅ Document operational requirements for onsite positions
✅ Assess the impact on national workforce strategies

On 1 July 2026, Australia's government-funded Paid Parental Leave scheme expanded to 26 weeks (6 months), giving eligible parents more time to focus on what matters most — their growing family. The changes also include superannuation contributions on Paid Parental Leave and increased flexibility for families to share leave between parents.
