One reminder worth setting.

If you’re captured by AML/CTF, here are 9 questions to ask whoever manages your IT systems.

1️⃣ If I asked who opened a particular client file in March, could you tell me? And could you tell me the same about the mailbox those documents were emailed to?
2️⃣ Which outside parties can reach our client identity data, and what do our agreements with them say about handling it?
3️⃣ How are client identity documents removed once we no longer need them, and does that happen automatically or does somebody have to remember?

And six more, plus what a good answer to each sounds like. All built from what the privacy regulator expects businesses to do.

AML/CTF covers collecting client ID. The Privacy Act covers what happens to it once it’s in your systems.

Most of the AML/CTF conversation has focused on checking client ID. Much less has been said about what happens to it afterwards.

You've confirmed you're captured, enrolled with AUSTRAC, and built your AML/CTF program. That's the first half done.

The next five steps depend on how your systems store, access, manage and protect client identity information.

Once you're captured under AML/CTF, the Privacy Act also applies to the client ID you collect. That makes technology, data management and access controls part of your requirements.

Most discussions about AML/CTF focus on policies, procedures and risk assessments. Far fewer focus on what happens to client identity information after it's collected.

For many businesses providing a designated service, records collected under AML/CTF requirements bring Privacy Act obligations into play.

The question is no longer just whether you're collecting the right information.

It's where that information is stored, who can access it, how long it's retained, and whether your business could demonstrate that if asked.

Our latest article explores what changed and what it means for the systems holding those records.

1 new client. 7 copies of their ID.

50 new clients a year. 350 copies.

Five years in, that's 1,750 copies of client identity spread across inboxes, phones, folders and backups.

The question for firms captured under AML/CTF isn't how many clients you verified. It's whether you know where all 1,750 copies are, who can open them, and when they'll be deleted.

Under the reforms, the Privacy Act expects you to.

If you provide a designated service, here's what this means for you: https://it.efex.com.au/aml-ctf

The recent AML/CTF headlines highlight an important shift. The focus is moving from being prepared to being able to prove it.

Recent reporting across the accounting and legal sectors suggests AUSTRAC is increasing its scrutiny of newly regulated businesses and seeking greater visibility into how obligations are being met.

For many firms, the challenge isn't understanding their AML/CTF obligations. It's being able to demonstrate how those obligations are supported across systems, documents, storage locations and access controls.

Policies don't store client identity documents. Technology does.
Policies don't control access. Technology does.
Policies don't create audit trails. Technology does.

If you're not sure whether your systems support your AML/CTF requirements, we've created a free 3-minute AML/CTF Technology & Data Checklist you can use to find out.
