Unfortunately it seems scams are a driving cause for us to post recently. We have been made aware, this week, of a new one... it seems that 'someone' has filed a bulk-request to appoint themselves as the agent/address for trade marks in Australia, without authorisation from the trade mark owners. The trade marks office is aware, and is investigating. Whilst that occurs, some 'automated' filings with the trade marks office will be frozen and handled manually. ⚠️ ⚠️⚠️ There seems to be a new trade mark related scam going around, being sent to business owners, indicating 'someone' is trying to register their trade marks and that action is needed. The information contained in the emails is fundamentally incorrect, and sadly, even worse is that they are signing off the emails with the names of properly registered trade marks attorneys. Our searches have found many red flags so PLEASE pay careful attention if you receive an email along the lines of the one captured in this post. If you're ever unsure, you can always contact us at [email protected] for assistance.

👉 The 'business' sending these (Patent Registry Hub) does not appear to have a corresponding business/company name registered in Australia

👉Patents and trade marks are different forms of IP. It's odd to have a 'business' name of Patent Registry Hub to promote trade mark services

👉The owner of the domain name patentregistryhub.com used to send the emails has used a privacy shield so cannot be easily identified

👉 The website promotes 'copyright' registration services. Copyright is not registered in Australia as it is an automatic right.

We've had a few experiences lately where a party to an opposition has gone the DIY route, and, have lost their case because of that. Had they received proper advice/engaged assistance the outcome could have been very different. From 1 October 2024 the IP office is implementing some new fees, including for certain trade mark matters (predominently in the opposition space). And, they are also increasing the costs that can be recovered if you are successful in an opposition/removal matter. This increase to the schedule of costs is welcomed, in my view. Currently, a trade mark opposition that is decided without a hearing could see an award of costs to the opponent (if successful) of around $1600. Looking at the new schedule, that is set to increase to arround $5000! I think this is a more reasonable amount for a successful party to recover, and, perhaps it will help deter oppositions that appear somewhat frivilous?
