Fake Indigenous procurement is stealing opportunities from our communities.

There is growing evidence across Australia of companies misrepresenting Indigenous ownership or partnerships in order to access government contracts and funding intended for First Nations businesses.

This practice — often called “black-cladding” — happens when a non-Indigenous business positions itself as Indigenous-owned, or uses a token arrangement with an Aboriginal or Torres Strait Islander staff, while the control, profits and decision-making remain elsewhere.

The result?

• Genuine First Nations businesses miss out on contracts
• Communities lose economic opportunities
• Government procurement policies designed to support Indigenous economic development are undermined

Programs like the Indigenous Procurement Policy were created to grow a strong Indigenous business sector and support self-determination. But those opportunities only reach communities when integrity and accountability are enforced.

This is why governance and compliance matter more than ever.

We need stronger verification, better oversight, and leadership that protects the intent of Indigenous procurement.

✔ Indigenous businesses must be genuinely Indigenous-owned and controlled
✔ Procurement must deliver real outcomes for First Nations people
✔ Governance and compliance frameworks must be strong enough to prevent exploitation

Let’s talk about the elephant in the room.

Black-cladding.

It’s something many people in the Indigenous business sector know exists, but too often it’s spoken about quietly — behind closed doors.

Black-cladding happens when businesses create superficial arrangements to appear Indigenous-owned so they can access Indigenous procurement contracts, while the real control, decision-making and profits sit elsewhere.

Let’s be honest about what this means.

Every time black-cladding occurs:
• Genuine Aboriginal and Torres Strait Islander businesses lose opportunities
• Indigenous entrepreneurs lose contracts that were meant to support their growth
• Communities lose the economic benefits these policies were designed to deliver

Indigenous procurement policies were established to support self-determination and economic empowerment — not to become loopholes for others to profit from Indigenous identity.

Those of us working across Indigenous governance, corporations and enterprise see the effort that genuine Indigenous businesses put in every day to build something sustainable for their families and communities.

So when the system is exploited, it doesn’t just undermine policy — it undermines trust in the entire Indigenous business sector.

🌿 Native Title Corporations (PBCs) 🌿

The National Indigenous Australians Agency (NIAA) is providing funding through the PBC Capacity Building Program to support Prescribed Bodies Corporate (PBCs) across Australia.

This funding helps Native Title Corporations strengthen governance, build organisational capacity, and create economic opportunities from their land and native title rights. 

💰 Funding available:
Projects can typically receive between $50,000 and $750,000 to deliver activities that strengthen PBCs and support long-term sustainability. 

📈 What the funding can support:
• Governance and leadership development
• Strategic and economic development planning
• Training and professional expertise (legal, financial, business support)
• Strengthening agreement-making and negotiations
• Building long-term organisational capacity for PBCs 

PBCs play a vital role in holding and managing native title rights on behalf of Traditional Owners, and this funding supports them to grow stronger and take advantage of new opportunities.
