Are Casual Employees entitled to Long Service Leave (QLD)
Many businesses ask us if casual employees are entitled to long service leave.
In Queensland the answer to that is "Yes, casual employees are entitled to Long Service Leave" and it is based on their ordinary hours worked through their entire continuous period of service.
Things to note:
1. If there has been a transfer of business, employees maybe entitled to long service leave for their period worked prior to their engagement in the current business.
2. If they break their employment for a period of 3 months (not including maternity leave) it maybe considered a "Break in Employment" and long service leave entitlement may not arise.
3. The entitlement for casual employees is based on the number of ordinary hours they have worked for the entire duration of their employment.
4. An employee who has completed at least 7 years continuous service is entitled to a proportionate payment for long service leave on the termination of the employee’s service
A lot of employers believe that the entitlement for long service leave is included in their 25% loading. This is not correct, however if you pay above award wages there are strategies which you can implement to have the long service leave entitlement included in their hourly rate.
