Can a resignation become a dismissal?

Surprisingly, yes.

If an employee resigns and gives notice, many employers assume they can simply decide the employee will finish immediately and pay out the notice period instead.

Unfortunately, it's not always that straightforward.

A recent Fair Work Commission decision reinforced that if an employer unilaterally brings forward an employee's finishing date, the employment may legally be considered a dismissal rather than a resignation - even if the employee receives all of their pay.

The good news? Avoiding this risk may be as simple as changing the way you have the conversation.

We’ve recently concluded our second workplace investigation of the year.

Running workplace investigations is one of the most challenging parts of what we do.

They’re detailed, time-consuming, and often far more complex than they first appear. But more than that - I’m acutely aware that they involve real people. Real experiences. Real consequences.

Every interview, every piece of evidence, every finding, carries weight. There’s big pressure in that. Not just to be thorough and technically sound, but to be fair, balanced, and to genuinely give it everything in order to reach that important balance of probabilities threshold.

Behind every allegation is someone who has spoken up, and someone who is responding. Both deserve a process that is careful, respectful, and absolutely grounded in integrity.

It’s not work we can or would ever rush. And it’s not work we take at all lightly.

The trust organisations place in us to handle these matters - often at their most sensitive - it isn’t lost on me. It’s at the forefront of my mind in every investigation we run.

So, while we enjoy the challenge that running investigations provides, the time between them is just as important - to reset and ensure we’re ready to step back into that level of responsibility.

Because this isn’t process-driven work. It’s people-driven. And it deserves to be treated that way, every single time.
