স্টেট ডিফেন্স ল ইয়ার : গোলকিপার বিহীন ডিফেন্ডার

The legal remembrancers Rules , 1960 এর দ্বাদশ অধ্যায়ের দফা (১) এ বলা হয়েছে যে ক্যাপিটাল পানিশমেন্ট হতে পারে এ ধরনের আসামিগণ যদি আর্থিক অস্বচ্ছলতার কারণে আইনজীবী নিয়োগ করে মামলা পরিচালনা করতে না পারেন তাহলে আদালত সংশ্লিষ্ট জেলার ডেপুটি কমিশনার কে অসচ্ছল আসামির পক্ষে একজন আইনজীবী নিয়োগ করার নির্দেশ দিবেন।
স্টেট ডিফেন্স নিয়োগের অন্যতম শর্ত হলো আসামি কে মামলায় প্রতিদ্বন্দ্বিতা করতে হবে এবং আর্থিকভাবে অসচ্ছল হতে হবে এবং অপরাধটি হতে হবে মৃত্যুদণ্ড যোগ্য অপরাধ।
উপরি উক্ত শর্তগুলো পূর্ণ হলেই কেবল একজন আসামি স্টেট কর্তৃক নিযুক্ত আইনজীবী বা লইয়ার পেতে পারেন যিনি তাকে ডিফেন্ড করবেন।
কিন্তু বাস্তবে হয়েছে উল্টো। মৃত্যুদন্ড যোগ্য অপরাধের মামলায় আসামি পলাতক হলেই ডিফেন্স ল ইয়ার আদালত নিজে নিজেই নিয়োগ দিয়ে থাকেন। ডেপুটি কমিশনার কে নির্দেশনা দেয়া বা ডেপুটি কমিশনার কর্তৃক উপযুক্ত আইনজীবী নিয়োগের অপেক্ষা আদালত করেন না। যা সম্পূর্ণ বেআইনি।
আসামি যেখানে পলাতক এবং মামলায় প্রতিদ্বন্দ্বিতা করছেন না সেখানে আবার ডিফেন্স কি?
ডিফেনডেন্ট তো নেই আইনজীবী কার সঙ্গে পরামর্শ করবেন আর কি ডিফেন্স নির্ধারণ করবেন?
মৃত্যুদণ্ড যোগ্য অপরাধের মামলায় প্রতিদ্বন্দ্বিতাকারী আর্থিকভাবে অসচ্ছল আসামির জন্য রাষ্ট্রীয় খরচে নিযুক্তিও আইনজীবীকে বলা হয় স্টেট ডিফেন্স ল ইয়ার।

Protecting Public Money.

Significance of the Artha Rin Adalat Ain, 2003.

Banks are the custodians of the public money. People generally deposit their money to the Banks for proper investment and transaction. Therefore, Banks lend and invest this Money to the Borrowers. Thus, the Banking transaction goes on.
But sometimes the problem arises when some borrowers become defaulters of repayment of the borrowed money and the Banks fall in a critical situation. For that reason, a proper legal process is highly required for the recovery of the money. And thinking the matter, the Government has enacted a special law in 2003 for the proper and speedy realization of the money from the defaulter borrowers. This special law is called the Money Loan Court Act, 2003 (popularly known as Artha Rin Adalat Ain).

This law has some special features. For Example, the Banks can file a suit against the defaulter borrowers but the Borrowers can not file any suit against the Banks under this special law. The Banks cannot file a case against their employees under this law for misappropriation of fund.
In the Corporate Sector, the special knowledge in this special law has an extensive significance. If this law is well-understood, it will certainly contribute to your Institutions. It is most important not only for the employees but also for the employers of all types of banking and Non-banking financial institutions.
