A few month ago the Council of Europe published a study authored by our Partner Asja Roksa Zubcevic. A few days ago, the findings of this study have been discussed at an event organised by the Vijeće Evrope - Ured u Sarajevu - Council of Europe Office in Sarajevo, and Asja had also the opportunity to be interviewed by Jelena Kalinic.

Asja cooperated with her former colleagues from Communications Regulatory Agency of BiH (CRA) in the preparation of the study “Towards coregulation of harmful content online in Bosnia and Herzegovina - A study of European standards and co-regulatory practices for combating harmful content online”.

The study focuses on the modalities for the establishment of a functioning and comprehensive cooperative co and regulatory mechanism, particularly considering the Digital Services Act (DSA), especially important for countries with EU candidate status.

Today, WH is so proud of our Partner Asja Roksa Zubcevic and our Associate Martina Chapman, for having authored this outstanding report on the new concept of "media freedom literacy" (MFL) for the OSCE Representative on Freedom of the Media.

MFL is defined by the report as "the knowledge and skills that enhance citizens ability to understand and value the democratic functions of the media and other information providers, online and offline, and the importance of a pluralistic, well-functioning media landscape serving the public interest, including critical evaluation and ethical production of information and media content".

A must read for all those who believe in the importance of both media freedom and media literacy for the health of democracy, and who are ready to work to foster them in these troubles times.

One of the latest studies authored by Asja Roksa Zubcevic, Partner at Wagner-Hatfield, is finally published.

Asja cooperated with her former colleagues from Communications Regulatory Agency of BiH (CRA) in the preparation of the study “Towards coregulation of harmful content online in Bosnia and Herzegovina - A study of European standards and co-regulatory practices for combating harmful content online”, produced with the support of the European Union and the Council of Europe.

The study focuses on the modalities for the establishment of a functioning and comprehensive cooperative co and regulatory mechanism, particularly considering the Digital Services Act (DSA), especially important for countries with EU candidate status.

The publication of the study was supported within the framework of the joint programme of the European Union and the Council of Europe “Horizontal Facility for the Western Balkans and Türkiye”, and its action “Protecting freedom of expression and of the media in Bosnia and Herzegovina (PRO-FREX)”.

The European Audiovisual Observatory - Observatoire européen de l'audiovisuel has published two mapping reports that Wagner-Hatfield Partners Jean-François Furnémont and Asja Roksa Zubcevic have co-authored with the Department for Legal of Information of the Observatory (Maja Cappello, Sophie Valais and Justine Radel).

The first one ("Mapping report on the rules applicable video-sharing platforms: focus on commercial communications") covers all EU member states, Norway and the UK. It provides a detailed, country-by-country analysis of national audiovisual law and the provisions in place to regulate commercial communications carried by video sharing platforms, and includes a pan-European comparative analysis. It reflects the state of play of October 2022.

The second one ("Mapping of national rules applicable to video-sharing platforms: harmful and illegal content online") also includes a pan-European comparative analysis, detailed country profiles, as well as the perspective of industry stakeholders. It reflects the state of play of May 2021 and contains information following an update in September 2022.

L'Organisation internationale de la Francophonie publie l'étude comparative sur les politiques publiques de ses 88 Etats membres, associés ou observateurs, que notre Partenaire Fondateur Jean-François Furnémont a rédigé en coopération avec Renaud de la Brosse (professeur à l'Université Linnaeus de Kalmar et à l'Université de Reims) et Abdourahamane Ousmane (ancien président du Conseil Supérieur de la Communication du Niger et directeur du Bureau d’Études et de Conseils en Afrique - BECAF).

Le rapport 1) analyse les politiques publiques de lutte contre la désinformation qui contribuent directement ou indirectement à prévenir et à lutter contre les désordres informationnels, 2) identifie les défis majeurs pour les politiques publiques de lutte contre la désinformation et 3) propose des recommandations opérationnelles, destinées à améliorer les politiques publiques de l’espace francophone.

Wagner-Hatfield continues expanding its network of Associates and, after Martina Chapman, Louise Doorman, Tanja Kersevan and Marc Le Roy, is excited to welcome Léa Chochon.

Léa graduated from the University of Nice Sophia Antipolis with a Master's degree in European Business Law. She completed her university education with specialised training from the World Intellectual Property Organization (WIPO), completing the general intellectual property course programmes and specialised courses on copyright and related rights.

She started her career in 2018 as an Analyst in the Department for Legal Information of the European Audiovisual Observatory - Observatoire européen de l'audiovisuel During her career, Léa has had the opportunity to participate as an author or research assistant in numerous publications and conferences of the Observatory, giving her an in-depth knowledge of European film and audiovisual regulation as well as expertise in managing research projects on a pan-European scale. Léa also worked in the Observatory's Department for Market Information, participating in the annual updates of the MAVISE and LUMIERE databases.

Her areas of expertise include the regulation of linear and non-linear audiovisual services in Europe, European policies and regulations related to the exercise and protection of fundamental rights in the digital space; international and national regulations related to public funding of film and audiovisual, and gender and diversity issues in the audiovisual industries.

Wagner-Hatfield is excited to have seen the publishing of the article written by our COO Asja Roksa Zubcevic and CEO Jean-François Furnémont in the Journal of Digital Media & Policy Vol. 12, n°3, edited by Rozgonyi Krisztina and Sally Broughton Micova.

Under the title ”Reclaiming digital democracy: A need for inauguration of regulated digital sovereignty”, we offer our view on functionally merging various initiatives, such as the and the proposed , outlining a proposal for allowing their constructive vertical and horizontal operationalism, having in mind the transnational nature of online services. We further argues that the institute of National Digital Services Coordinators should be established in the form of national digital forums headed by media regulatory authorities, with competition, election and data-protection national authorities, vertically supported and consulted with the media/fact-checkers and academia. The proposed structure should be there not to protect any singular interest, but everyone’s collective interests, and the proposed functioning scheme recognizes the regulatory and advisory system with vertical and horizontal integration of the identified players. In place of naïveté in expecting dramatic and revolutionary response to addressing the problems and dangers in the online media environment, our commentary attempted to offer practical solutions to retaining the basic premise of democracy, while maintaining the vital importance of the right to freedom of expression.

Ces 8 et 9 novembre, le REFRAM a organisé un séminaire sur la régulation des médias à l’ère des plateformes, avec comme objectif d'accentuer sa réflexion dans ce domaine et initier des actions spécifiques visant à mobiliser l’ensemble des parties prenantes francophones dans la préparation d’une stratégie efficace pour relever les nouveaux défis de cette ère numérique.

Notre CEO Jean-François Furnémont a eu le plaisir de faire office de rapporteur général.

Un rapport suivra dans quelques semaines, qui proposera des recommandations aux organisations internationales (en particulier à Organisation internationale de la Francophonie (OIF), partenaire du au REFRAM) et au REFRAM et à ses membres en vue de l’adoption de la future feuille de route pour 2022-2023.

Le Réseau francophone des Régulateurs des médias (REFRAM) est un des 16 réseaux institutionnels de la Francophonie. Il vise à l’établissement et au renforcement de la solidarité et des échanges entre ses membres. Il constitue un espace de débats et d’échanges d’information sur les questions d’intérêt commun aux autorités de régulation des médias et contribue aux efforts de formation et de coopération.

Our last study, commissioned by Slovenski filmski center / Slovenian Film Centre in the framework of the Slovenian Presidency of the Council of the EU 2021, is out.

It highlights the best practices of the following EFAD - European Film Agency Directors -aisbl members: Vlaams Audiovisueel Fonds, Centre du Cinéma et de l'Audiovisuel, Icelandic Film Centre - Kvikmyndamiðstöð Íslands, Screen Ireland, Lietuvos kino centras and Film Fund Luxembourg.

It also suggests policy recommendations to be considered at the EU level, especially by European Commission, Creative Europe but also by European Broadcasting Union - EBU.
