The short answer is: Not necessarily.

The Bill does not say that every person with a Facebook account, TikTok page, YouTube channel, podcast, or social media profile must obtain a broadcasting licence.

However, the Bill does create a new category called a National Online Broadcasting Service and defines a national online broadcaster as someone who broadcasts primarily through internet-based platforms, targets audiences in Belize, and derives most of their advertising or sponsorship revenue from Belizeans.

That immediately raises several important questions:
โ€ข Does audience size matter?
โ€ข Does earning advertising revenue matter?
โ€ข Does posting everyday matter?
โ€ข Would a political commentator be treated differently from an ordinary social media user?
โ€ข Would a podcast qualify?
โ€ข Would a Facebook livestream qualify?

The Bill does not clearly answer those questions.

Instead, it allows the Broadcasting Authority to establish criteria and exemptions later. Factors that may be considered include audience size, frequency of broadcasts, whether revenue is generated, and other matters the Authority considers relevant.

The legislation allows for the creation of a future Broadcasting Code of Conduct that licensees would be required to follow.

Under the Bill, the Code may require broadcasters to ensure content is not:
โ€ข detrimental to public morality;
โ€ข detrimental to public order;
โ€ข detrimental to public health;
โ€ข discriminatory;
โ€ข potentially harmful;
โ€ข potentially offensive; or
โ€ข contrary to certain professional and ethical standards.

The question is whether these standards are defined clearly enough.

For example:
โ€ข What exactly is "public morality"?
โ€ข What qualifies as "offensive"?
โ€ข Who decides what professional and ethical standards require?
โ€ข Would different governments interpret these terms differently?

The proposed Belize Broadcasting Authority (BBA) would be the primary regulator under the new law.

Its powers would include the ability to:
โ€ข issue licences;
โ€ข investigate complaints;
โ€ข obtain records and information;
โ€ข issue compliance orders;
โ€ข issue takedown orders;
โ€ข impose administrative penalties;
โ€ข suspend licences;
โ€ข revoke licences;
โ€ข bring legal proceedings; and
โ€ข issue administrative instructions, directives, and guidelines.

Is that unusual? Not entirely.

Broadcasting regulators in many countries possess licensing and enforcement powers.

The real policy question is whether those powers are accompanied by sufficient safeguards, oversight mechanisms, transparency requirements, and appeal rights.

The answer is: Under certain circumstances, yesโ€”but not automatically.

The Bill creates a system of compliance orders and takedown orders. Where a broadcaster continues operating unlawfully or refuses to comply with lawful directives, the Authority may apply to the courts for additional remedies.

The court may order:
โ€ข domain blocking;
โ€ข IP address blocking;
โ€ข blocking of mirror sites; and
โ€ข other technical measures designed to stop unlawful broadcasts.

An important safeguard

The Authority cannot simply decide on its own to block websites.

The blocking provisions require court involvement and judicial approval. The court must also be satisfied that the proposed measures are necessary and proportionate and contain safeguards for lawful content.

That distinction is important.

Many of the questions people are asking cannot be answered directly from the Bill because the answers are intended to come later through:

โ€ข Authority directives;
โ€ข guidelines; and
โ€ข the future Broadcasting Code of Conduct.

For example, important details relating to:
โ€ข online broadcaster exemptions;
โ€ข content standards;
โ€ข domestic content requirements;
โ€ข licensing thresholds; and
โ€ข other compliance requirements

may be developed after the law is passed.

The Bill is not solely about online speech.

Large sections of the legislation are aimed at addressing:
โ€ข broadcast piracy;
โ€ข unauthorized streaming services;
โ€ข IPTV distribution;
โ€ข copyright enforcement;
โ€ข licensing of modern broadcasting systems;
โ€ข consumer protection;
โ€ข emergency broadcasting requirements; and
โ€ข support for Belizean content creators and domestic broadcasting services.

The accompanying Regulations also establish new licensing categories for modern broadcasting services and create mechanisms for supporting domestic channels and Belizean content.

These are real policy challenges that Belize, like many other countries, must address.

The Draft Regulations create seven categories of licences:

โ€ข Category III โ€“ Free-to-Air Broadcasting Service (Varies by coverage area)
โ€ข Category IV โ€“ Multi-Channel Streaming Broadcasting Service ($50,000)
โ€ข Category V โ€“ Multi-Channel Linear Broadcasting Service (Varies by municipality)
โ€ข Category VI โ€“ Broadcast Resale and Marketing Service ($3,000)
โ€ข Category VII โ€“ National Online Broadcasting Service ($2,000)

Applicants would generally be required to provide ownership information, tax compliance records, technical information, and evidence of copyright authorization where applicable.

The real question is whether this Bill strikes the right balance between:
โ€ข modernizing outdated laws;
โ€ข addressing streaming and digital broadcasting;
โ€ข protecting copyright and intellectual property;
โ€ข holding influential media actors accountable; and
โ€ข preserving clear protections for freedom of expression and public discourse.

The strongest argument in favor of the Bill is that Belize's communications landscape has changed dramatically and the law must change with it.

The strongest criticism is that several important powers and standards are broad, while many critical definitions and safeguards will be determined later.

Ultimately, the conversation centers whether this particular Bill provides enough clarity, accountability, and protection for the rights and freedoms of this modern era.

COP31 is right around the bend. And young people will be โ€œengaged.โ€

They will be invited to panels, quoted in campaigns, featured in photos, added to consultations, and celebrated as the future.

But too often, youth engagement stops at the optics and tokenism.
