PR on Humanitarian and Compassionate Grounds? You bet!

It may be a slow-moving process, given the current processing times, but it does move forward.

Today, I’m delighted to congratulate our clients on an important milestone: the family has received first-stage approval of their application for permanent residence on Humanitarian and Compassionate grounds.

There is still a road ahead before permanent residence is finalized, but this is a very welcome step forward.

A good ending to the working week, and a particularly good Friday afternoon for this family.

ILAC Shuts Down, But Your Work Permit Is Valid for Another Year. Can You Keep Working?

Suppose you are an international student at ILAC with a co-op/work authorization valid for another year, and the school suddenly cancels classes or ceases operations. Can you keep working simply because the permit has not expired?

Not necessarily.
Student work authorization is tied to meeting the conditions of your study program. If you are no longer studying, or are between institutions, you may have to stop working until you resume studies and meet the applicable requirements.

There is an important nuance: IRCC recognizes certain school closures as an authorized leave of up to 150 days, allowing eligible students to maintain their status. But this does not mean work authorization continues indefinitely.

What are your options?

1. Transfer to another DLI
Find a new eligible program and follow IRCC's current school-transfer and study-permit requirements. Check the new program carefully for PGWP eligibility before committing.

2. Change to visitor status
If you need time to assess your options, a Visitor Record may allow you to remain in Canada lawfully. It does not preserve your right to work or study.

3. Explore PR
You may qualify independently through Express Entry, a PNP, or another pathway. Your eligibility will depend on factors such as skilled work experience, language results, education, age and provincial connections.

The key point: a school closure is not simply an administrative inconvenience. You need to assess status, work authorization, your replacement program, PGWP eligibility and possible PR pathways together.

The expiry date printed on your permit is only one piece of the puzzle.

Well, these are extremely busy weeks, leaving very littlt time for anything elsem but the case work.

Yet, I do keep track of inquries, and this distress call deserves a special mntionuing:

"Hello, I’m really stressed right now. I just received a message saying that my spouse's SOWP application from outside Canada was refused. This is the reason they gave. My NOC is TEER 5, but I applied under the T13 pathway because I have a Provincial Nominee Program (PNP) certificate. Does this mean that my husband is not eligible for an SOWP even though I have a PNP nomination and my T13 work permit has been approved? Can we still reapply? If so, how long should we wait before submitting a new application, and approximately how many weeks could the new application take?"

I find this refusal odd. Not knowing much about the specifics of the situation (this is just a FB group, after all), off the top of my head, the previous application was likely refused due to the January 21, 2025 policy update, which restricts SOWP eligibility for spouses of workers in TEER 4 and 5 occupations under the standard foreign worker framework. However, the principal applicant is not applying under the standard framework. The application falls under the federal provision for “Workers on a pathway to permanent residence through an eligible stream.” As evidence of this pathway, the spouse holds an approved Provincial Nominee Program (PNP) nomination and a valid T13 LMIA-exempt work permit.

According to IRCC’s instructions for spouses of foreign workers, a principal applicant employed in a TEER 4 or 5 occupation may be eligible to support a spouse’s SOWP application if the principal applicant is on an eligible pathway to permanent residence, including the Provincial Nominee Program, and the other requirements are met. The current T13 work permit should also satisfy the specific requirement that the principal applicant’s work permit remain valid for at least 6 months after the spouse’s application is submitted.

It appears, that the officer applied the wrong section to the case! Will see how all this unfolds, I think we have the right set of tools to get this rectified.

What qualifies an inquiry for a Tier 0 Diagnostic?

Tier 0 is intended for a narrowly defined immigration issue that can be addressed without stepping back and assessing the person’s broader immigration strategy.

It might be a specific question about an existing application, a defined status issue, a particular document or procedural requirement, a focused eligibility question, or a second opinion on a specific immigration issue.

But sometimes that “one question” is really the starting point for several other questions. If answering it requires looking at multiple immigration pathways, a complicated immigration history, significant risk factors, or broader strategic decisions, a more comprehensive Diagnostic may be needed.

So the issue is not how many questions you have. It is how much needs to be considered to answer the question properly.
