🤝They explore when employers are legally and ethically obligated to investigate, including situations involving formal complaints and management awareness of potential misconduct. Dean breaks down the role of threshold analysis in determining when an investigation is necessary.

Amy and Dean also address a broader organizational risk: workplace issues are often known long before a formal investigation begins. Dean introduces the concept of internal “watchers” and explains how tolerated behaviour can escalate into significant legal and cultural exposure if left unaddressed.

Our focus: The Five Fatal Flaws in Workplace Investigations.

Most investigation failures aren’t obvious at the start - they surface only when challenged, creating unnecessary risk and liability.

Common issues include:

👉 No structured investigation plan
👉 Inconsistent interviews
👉 Weak credibility analysis
👉 Inadequate documentation
👉 Conclusions unsupported by evidence

These gaps are avoidable. With the right frameworks and training, investigations can be sound, defensible, and compliant.
