ALBERTA CONDOMINIUM ACT UPDATED (2014) TO INCLUDE MEDIATION

Mediation is included in the Act to help parties through their differences.
Changes to the Condominium Property Act will:
-enhance dispute resolution
-improve protection for purchasers and for existing owners;
-enhance board transparency and accountability;
-allow for efficient governance;
-raising of standards in AB's condo. management sector.

ALBERTA CONDOMINIUM PROPERTY ACT USES MEDIATION TO RESOLVE DISPUTES.

The Alberta Condominium Property Act and Regulation (updated in 2000) recognizes the use of mediation and arbitration to resolve disputes other than court action (section 77).
Resolving Disputes

If a condominium dispute cannot be resolved by speaking directly with the person involved or filing a complaint with the condo board, then it can be resolved using mediation and/or arbitration as an alternative to court action.

Mediation and/or arbitration are processes that involve using an objective third party--a mediator. A mediator helps the parties negotiate their own resolution to the problem, whereas an arbitrator makes a decision for the parties after all the parties present their cases.

All those involved need to agree on the process and on a mediator or arbitrator. If they cannot agree on a mediator or arbitrator then one can be appointed to them. The parties involved pay the costs of the dispute resolution.
