Effective January 21, 2025, only spouses of certain international students and foreign workers will be able to apply for a family OWP.

Family OWPs will be limited to spouses of international students who are enrolled in

♦️master’s programs that are 16 months or longer
♦️doctoral programs, or
♦️select professional and eligible programs

Family OWPs will also be limited to spouses of foreign workers who are employed in

♦️TEER 0 or 1 occupations, or
♦️select TEER 2 or 3 occupations in sectors with labour shortages or linked to government priorities

These include occupations in the natural and applied sciences, construction, health care, natural resources, education, sports and military sectors. The full list will be available on January 21, 2025.

These changes are part of a broader series of measures that were announced last year, in an effort to overhaul Canada’s current temporary foreign worker and student programs. The changes are meant to bring long-term labour market stability, as well as reinforce the integrity of the student and worker programs.

Earlier this month, IRCC announced updated requirements for Study permit applicants who have applied on or after November 1st, 2024.

The new requirements are as follows:

If you graduated from a university bachelor’s degree, master’s degree or doctoral degree program:

Language requirement: You must prove your English or French language skills with a minimum level of Canadian Language Benchmarks (CLB) 7 in English or Niveaux de competence linguistique canadiens (NCLC) 7 in French in all 4 language areas.
Field of study requirement: All fields of study are eligible. There is no additional field of study requirement.

If you graduated from any other university program:

Language requirement: You must prove your English or French language skills with a minimum level of CLB 7 in English or NCLC 7 in French in all 4 language areas.
Field of study requirement: You must graduate in an eligible field of study.

If you graduated from a college program or any other program not listed above:

Language requirement: You must prove your English or French language skills with a minimum level of CLB 5 in English or NCLC 5 in French in all 4 language areas.
Field of study requirement: You must graduate in an eligible field of study.

The eligible fields of study are broken down into 5 broad categories:

1. Agriculture and agri-food
2. Healthcare
3. STEM (science, technology, engineering, and mathematics)
4. Trade
5. Transport

A new update from the official Alberta Advantage Immigration Program’s (AAIP) website states the following:

As of September 30, 2024, candidates must submit a Worker Expression of Interest (EOI) if they are interested in receiving an invitation to apply to one of the Alberta Advantage Immigration Program’s (AAIP’s) worker streams.

There is no fee to submit a Worker EOI.

Candidates will self-declare information about themselves through an online Worker EOI form in the AAIP portal. Each Worker EOI will be scored and ranked using the Worker EOI points grid. Candidates who successfully submit a Worker EOI will be placed into the Worker Stream pool to be considered for selection.

The AAIP will conduct ongoing draws from the Worker Stream pool for specific worker streams and pathways. The AAIP will select and invite candidates from the Worker Stream pool based on candidate EOI score rankings and provincial labour market needs and priorities, available AAIP nominations, and application levels. Individuals who are selected will receive an invitation to apply by email.

It is important to note that while the new system will be available on September 30, 2024 at 10 am, there is no need to rush to submit a Worker EOI as the AAIP will not conduct draws from the Worker Stream pool until mid or late October 2024.

The implementation of this new system will ensure that candidates will not have to stress about submitting an application before slots are filled. This method will ensure that all interested candidates will be allowed ample time and opportunity to express their desire to migrate to the province of Alberta based on the merits of their prior work experience and qualifications.

On September 18, 2024, IRCC announced significant changes to their various immigration programs, highlighted in the list below (quoted from Canada.ca):

♦️The proposed reduction of temporary residents from 6.5% of Canada’s total population to 5% will be reflected in the 2025–2027 Immigration Levels Plan, which will be released by November 1, 2024.

♦️Graduates from programs at public colleges will remain eligible for a Post-Graduation Work Permit (PGWP) of up to three years if they graduate from a field of study linked to occupations in long-term shortage.

♦️As part of changes to the PGWP Program, all applicants will be required to demonstrate a minimum language proficiency in French or English. This will increase their ability to transition to permanent residence and adapt to changing economic conditions. A Canadian Language Benchmark (CLB) level 7 for university graduates and CLB 5 for college graduates will be required for anyone applying for a post-graduation work permit on or after November 1, 2024.

♦️The 2025–2026 study permit intake cap will include master’s and doctoral students who will now have to submit a provincial or territorial attestation letter. We will be reserving approximately 12% of allocation spaces for these students in recognition of the benefits they bring to the Canadian labour market.

♦️On January 1, 2024, the cost-of-living requirement for study permit applicants was updated to better reflect the true cost of living in Canada and help prevent student vulnerability and exploitation.

♦️Budget 2024 proposes $743.5 million over 5 years, starting in 2024–2025, and $159.5 million ongoing to support the stability and integrity of Canada’s asylum system.

These measures intend to curb the sudden influx of temporary residents in Canada, in order to better manage demand and supply of foreign labor, as well as introduce stability and long-term sustainability to the Canadian Immigration system.

On August 30, 2024, the Government of Saskatchewan announced two new talent pathways under the Saskatchewan Immigrant Nominee Program (SINP) to grow the workforce in the agriculture and healthcare sectors.

Agriculture is the backbone of the Saskatchewan economy, and the new Agriculture Talent pathway will enable producers to access the talent they need to continue feeding the world, growing the value of exports, increasing value-added agriculture and harnessing new technologies and innovations. This pathway will help meet the increased demand for labour to fill in-demand and emerging jobs in the agriculture industry.

The new Health Talent Pathway will support the Government of Saskatchewan's Health Human Resources (HHR) action plan, as the SINP is an important resource for the health care sector to recruit and retain skilled workers. Immigration, Refugees and Citizenship Canada (IRCC) has abruptly terminated a temporary policy that allowed visitors to apply for work permits within Canada. The measure, introduced in August 2020 to assist those stranded due to COVID-19 travel restrictions, ended on August 28, 2024, before its scheduled February 2025 expiration. IRCC cited the need to recalibrate temporary resident numbers and maintain the integrity of the immigration system as reasons for the early cessation. The decision also aims to prevent exploitation by those misleading foreign nationals into unauthorized work. Applications submitted before the cutoff date will still be processed under the policy.

The Federal government’s sweeping immigration changes since the beginning of this year has created a climate of uncertainty. However, there are still plenty of viable options for foreign nationals to choose from within the Canadian immigration system.

On August 27, 2024, Immigration, Refugees and Citizenship Canada (IRCC) held the fifth Express Entry draw for the Canadian Experience Class (CEC) candidates of the year. IRCC issued 3,300 Invitations to Apply (ITA) to candidates in the CEC-targeted draw. In round #312, the cut-off score was 507, 2 points fewer than the precious CEC-targeted draw on August 14, 2024. The tie-breaking rule for this round was June 05, 2024, at 01:08:58 UTC. As of August 27, 2024, 205,137 profiles were registered in the Express Entry pool. In 2024, Canada issued 78,963 invitations through the Express Entry draws.

On August 19, 2024, Alberta published the update considering the Alberta Advantage Immigration Program (AAIP) inventory. According to the new update, there were around 2,766 Alberta Opportunity Stream applications, 1,886 Rural Renewal Stream applications, 27 Tourism and Hospitality Stream applications, and 812 applications under the Alberta Express Entry stream. In addition, on July 30 and August 13, 2024, the AAIP invited 57 and 41 candidates under the Dedicated Healthcare Pathway, respectively. This year, Alberta invited 832 candidates through the AAIP Express Entry streams.

Provincial nomination programs are a great way to gain Permanent residency for Temporary foreign workers. The process is generally more streamlined and personable compared to similar Federal programs.

The Federal Government has revealed plans to introduce a new immigration pathway for workers in Canada in TEER 4 and 5 occupations. While details remain scarce, it is anticipated that more information will be provided by Fall 2024. Workers in these categories currently rely on Provincial Nominee Programs for permanent residency. The new pathway aims to meet the labour market needs by allowing businesses to attract and retain TEER 4 and 5 workers. It is expected to have similarities with the Canadian Experience Class program, focusing on those with one year of full-time Canadian work experience.

Though the Federal Government has instituted many changes to immigration policy since the beginning of the year, over the long term, this will help stabilize the Canadian economy and will translate to better opportunities in the long term for Temporary Foreign Workers.

These fraudulent actors promise jobs and demand exorbitant fees ranging from $2,000 to $200,000. Victims often deplete their savings or incur debt, leading to long-term financial and emotional distress. Alberta's immigration authorities and advocacy groups are taking measures to combat this scam and support affected individuals. The federal government has also increased penalties for non-compliant employers to protect worker rights.
