What Factors Does IRCC Consider When Assessing a Humanitarian & Compassionate (H&C) Application?
Every Humanitarian & Compassionate (H&C) application is assessed on its own unique circumstances. While no single factor guarantees approval, IRCC may consider:
✔️ Your establishment in Canada
✔️ Your ties to Canada
✔️ Health considerations
✔️ Family violence considerations
✔️ The consequences of separation from close family members
✔️ Conditions in your country of origin (not related to refugee protection)
✔️ Any other relevant humanitarian circumstances you ask IRCC to consider
If a child is directly affected, IRCC will also consider the best interests of the child, including factors such as:
• Age
• Establishment in Canada
• Education
• Medical needs
• Conditions in the country of origin
• Gender, where relevant
Remember: The best interests of the child are an important consideration, but they are one of several factors assessed. Supporting documents and detailed evidence are essential to help IRCC understand your circumstances.
