Your work permit expires this year. What’s your plan? ⏳

Waiting until the last minute can leave you with fewer options.

Depending on your circumstances, an expiring work permit may be followed by an extension, a new employer-supported permit, an LMIA-exempt option or another immigration pathway.

And timing matters.

If you submit an eligible application to extend or change your work permit before it expires, you may be able to maintain your status while IRCC processes your application.

But the right strategy depends on more than an expiry date.

Before promoting a foreign worker, check more than the new job title.

An employee on an employer-specific work permit may have authorization connected to a particular employer, occupation and work location. Changes to responsibilities, pay, the job itself or the employer can require a review of their work permit conditions.

A promotion may therefore need closer attention if it involves:

📌 materially different duties
📌 a different occupation
📌 compensation or employment-condition changes
📌 a new work location
📌 a transfer to another employing entity

The objective isn’t to avoid promoting international employees. It’s to assess the immigration implications before the new arrangement is implemented, when the company has more opportunity to plan appropriately.

Y eso también puede tener implicaciones migratorias.

Si tienes un permiso de trabajo específico para un empleador, tu autorización puede incluir información sobre el empleador, la ocupación y el lugar donde puedes trabajar.

¿Significa que cualquier ascenso requiere un nuevo permiso? No necesariamente.

An LMIA is only one way to support a foreign worker’s Canadian work permit.

Depending on the candidate and the position, an employer may be able to hire through an LMIA-exempt category under the International Mobility Program.

Potential pathways can arise through free trade agreements, Francophone Mobility, intra-company transfers and other categories that support Canada’s economic, social or cultural interests.

However, LMIA-exempt does not mean the employer has no responsibilities.

In most employer-specific cases, the company must submit the employment offer through the Employer Portal, pay the applicable compliance fee and provide the worker with an offer of employment number.

The strategic question should not be:

“How do we obtain an LMIA?”

It should be:

“Does this hire require one in the first place?”

Global Talent Stream ≠ Global Skills Strategy. 🇨🇦

The names are similar. Their roles are not.

The Global Talent Stream (GTS) is an LMIA pathway within the Temporary Foreign Worker Program for eligible employers hiring certain highly skilled foreign workers.

The Global Skills Strategy (GSS) is broader and includes faster work permit processing measures for certain eligible and complete applications.

Can one hiring situation involve both? Yes, in some cases.

But they are not interchangeable.

Before deciding on a pathway, employers should consider the occupation, candidate, company and whether an LMIA is required.

Choosing an option simply because it sounds “fast” can be the wrong strategy if the eligibility requirements don’t fit.
