Hello, 2026. Goodbye, Facebook. I realize that many Indigenous communities and individuals use Facebook extensively, and even exclusively, but I'm out. This platform has veered so far from its original purpose, and is filled with disinformation, AI-generated fake images and articles, and adding posts of things I do not want to see, that I won't be posting on issues or stories here anymore.

It's still me, Jennifer David. I'm still a Senior Consultant at NVision Insight Group. I still lead our Truth and Reconciliation service basket, and we still provide learning opportunities and reconciliation advisory services.

And I still want to share insights and knowledge about Indigenous issues on social media; it just won't be here, anymore.

This an important precedent:
"The majority confirmed that the Declaration Act:

incorporates UNDRIP into the positive law of the province with immediate legal effect,
creates a statutory duty to align provincial laws with UNDRIP through consultation and cooperation, and
permits courts to adjudicate whether provincial laws are consistent with UNDRIP."

It will likely take a court case to ensure Canada's laws are consistent with UNDRIP. Interesting times.

Canada and the provinces have made laws regarding Indigenous Peoples, usually to harm them. They had no trouble enforcing them. Now here's a law that supports Indigenous rights. And now, they must enforce it.

BREAKING: The Court of Appeal has ruled that the Declaration on the Rights of Indigenous Peoples Act (DRIPA) is legally enforceable and that First Nations can hold the Province accountable when it fails to meet its obligations. This represents a massive milestone for Indigenous rights in British Columbia.

The ruling comes from Gitxaała Nation’s appeal in their challenge of B.C.’s outdated 'free entry' mineral tenure system. The Court found that B.C.’s mineral claim process is inconsistent with the U.N. Declaration and confirmed that the Province has a legal duty to work with Nations to align its laws.

Congratulations to Gitxaała on this victory and upholding Gitxaała law.

We live in a world with a quicker and quicker news cycle. In all the noise from across the border, remember Bill C-5? It hasn't gone away. Indigenous nations and governments are not always opposed to development per se, but they are right to be worried when the federal government invokes the vague, and usually threatening "national interest". Trampling on Indigenous rights "is what Canada has always done." I hope Canada is not turning its back on its promises. Let's demand better.
