A trade union rep companion has been rude and argumentative at previous disciplinary hearings.

Can I stop them coming again?

Workers can be accompanied at a disciplinary or grievance hearing by their chosen companion and you really don't have much say in who that companion is, provided it is a trade union rep or a colleague. If you refuse the employee's chosen companion, then this is likely to be seen as a breach of the employee's rights, even if it is because the companion has been rude or argumentative at previous meetings. Compensation for breaching this right is a maximum of two weeks' pay. A week's pay is capped at £643 from April 2023.

What are the NMW rates changing to in April 2023?

The national minimum wage (NMW) rates will increase on 1 April 2023 as follows:

23+ year olds = £10.42 per hour;
21-22 year olds = £10.18;
18-20 year olds = £7.49;
16-17 year olds = £5.28.

Apprentices who are under 19, or 19 or over but in the first year of their apprenticeship, will receive £5.28 per hour.

What support can I offer an employee with endometriosis?

Endometriosis is a condition that affects women and those assigned female at birth. The lining of the womb begins to grow on other organs outside of the womb and can cause debilitating effects on the person. For example, sufferers can experience chronic pelvic and lower back pain, pain when using the toilet, heavy periods, problems getting pregnant, diarrhoea, constipation, bloating, nausea, fatigue. Depending on the severity of the impact, those with endometriosis can be absent from work more often than others. You should sensitively and confidentially discuss the employee's situation with them and remain aware that each person can be affected differently, so it's best to take an individual approach. Consider any adjustments that may relieve some of the impact, for example, offering flexibility around working hours, adjusting the employee's work requirements at specific times of the month, allowing longer or more frequent breaks at work, considering the employee's menstrual cycle when organising their work schedule etc. Endometriosis can be a disability if it meets the required criteria; this would have to be judged on an individual basis.

Statutory sick pay (SSP) will increase to £109.40 per week from 6th April 2023; it's currently £99.35. There are several eligibility criteria which apply to the payment of SSP, including earning a minimum amount per week. This is called the Lower Earnings Limit which is £123 per week since April 2022 and this rate will not change in April 2023 when the other rates are subject to an increase - it will remain at £123.

Can an employee take time off for dependants for teacher strikes?

Time off for dependants is a right available to employees who need time off to deal with an unforeseen emergency affecting a dependant, which includes the unforeseen disruption to normal care arrangements for their child. It is usually used for short notice disruptions, for example, when a child wakes up ill one morning and so cannot go to school that day. It is not solely restricted to those very short notice disruptions and case law has shown that it can be used for something that an employee knew about in advance provided that they had tried to make alternative arrangements but had been unable to, which could be the case with a known school closure due to striking teachers. In most cases, the employee will know that they have been unable to sort out something else so should approach you to discuss what will happen on the day, however, even where this doesn't happen, time off dependants is not off the table. It is unpaid, unless the employee's contract says that it will be paid.
