Data privacy is the right of an individual to have control over how personal data is collected and used.

So what exactly is personal data?🤔

Personal data, also known as personal information (PI) or personally identifiable information (PII), is any information related to an identifiable person.

PI will have different definitions based on the relevant privacy legislation depending on where you are located. In Canada, for e.g. the privacy legislation that governs private sector organizations, PIPEDA, PI includes any factual or subjective information, recorded or not, about an identifiable individual. This includes information in any form, such as:
✔️ age, name, ID numbers, income, ethnic origin, or blood type;
✔️ opinions, evaluations, comments, social status, or disciplinary actions; and
✔️ employee files, credit records, loan records, medical records, existence of a dispute between a consumer and a merchant, intentions (for example, to acquire goods or services, or change jobs).
✔️and more!

Do you know the types of PI that you collectâť“

Do you know what is not considered PIâť“

Did you know that the higher the level of sensitivity of PI that you collect the greater the obligation is to protect itâť“

R is for showing Respect for the personal information (PI) you collect.

The PI you collect NEVER belongs to you (the business), you are the custodian/guardian of that PI and you have a legal obligation to use adequate measures to protect it, use it only for the purpose for which it was collected, allow the PI owner to access/update/correct the PI you have and withdraw consent for you to use their PI, if needed, among other things.

So how can you reduce the burden placed on you when you collect your customers’ PI, one easy way is to practice limiting the type of PI you collect. Don’t be that business that collects as much PI as the customer will willingly give in the hope of using it for something in the future – the more PI you collect the harder it is to protect and the more risks you expose your business to.

Before collecting, ask yourself:
- Why am I collecting these types of PI, i.e. what purpose will I be using it for?

- Why am I collecting these types of PI, i.e. what purpose will I be using it for?

- Is it absolutely necessary to collect ALL this PI for this purpose?

- Do I have the necessary measure in place to securely protect the PI collected?

- Is there another way to fulfil this purpose without collecting these types of PI?

With the call of the federal election, Canada’s Consumer Privacy Protection Act has died on the table.

Introduced in November 2020, this federal bill was meant to strengthen Canada’s private sector privacy law with new powers given to the privacy commissioner, heavy fines, expanded rights of private action, etc. However, it paled in comparison to stronger privacy laws like the EU’s .

So what does the future hold for Canada’s private sector ? Only time will tell but one thing is for sure, privacy changes are inevitable and any proposed law will be tougher as can be seen in the plan put forward by some political parties. For example, the Conservative Platform in their plan states that "We will pass strong legislation to protect privacy more effectively than the current government’s weak Bill C-11."
