On June 21, 2024, Immigration, Refugees and Citizenship Canada announced a change to the post-graduation work permit (PGWP) application process.

🚫Foreign nationals will no longer be eligible to apply for a PGWP at the border, a move designed to curb the practice of "flagpoling."

📌Flagpoling refers to temporary residents of Canada circumventing regular waiting times for work or study permits by exiting and re-entering the country for immediate immigration services.

This activity has been a drain on border resources, distracting officers, causing delays for travellers, and slowing the transit of goods. Around a fifth of all foreign nationals attempting to flagpole within the last year were PGWP applicants.

The Canadian Government is considering changes to the Post-Graduation Work Permit (PGWP) program, potentially linking it to areas of labour shortage.

📝The plan may limit overall access to the program but aims to align PGWP eligibility with labour market demands, improving employment outcomes for international students.
✅Currently, PGWP is open to all international graduates from publicly funded programs without work restrictions.

📌The proposed changes could significantly alter this. Immigration, Refugees and Citizenship Canada (IRCC) requests feedback on which jobs should qualify for PGWP and whether some student groups should be exempt. The government is also considering requiring a job offer for PGWP holders after one year, along with other potential criteria like language skills.

Canada has begun to limit the practice of flagpoling at 12 ports of entry.

📌Flagpoling, a legal procedure that enables individuals on temporary residence permits to attain same-day immigration services by exiting and re-entering the country within a 24-hour period, is typically performed at designated locations at land border crossings.

🔍Despite its legality, the practice has drawn criticism from Canadian and US entities and is now curtailed at 12 crossing points. The Canada Border Services Agency (CBSA) has announced this measure as an attempt to enhance efficiency during high-traffic periods and allow officers to concentrate on high-priority cases such as trade facilitation, high-risk travellers, and asylum seekers.

Canada's Immigration Minister Marc Miller introduced new pilot programs for foreign caregivers, replacing soon-to-expire programs. The initiatives acknowledge caregivers' vital roles and grant them permanent residence upon arrival.

✅They can work for organizations providing temporary or part-time care for semi-independent individuals or those recovering from illnesses.

📝This approach ensures suitable employment and clear access to permanent residency.

📌Applicants must meet criteria including language proficiency, equivalent Canadian high school education, relevant work experience, and a full-time home care job offer. This move shows Canada's commitment to addressing its population's diverse home care needs.

On June 03, 2024, the Government of Canada announced several changes to the Agri-Food Pilot to better align it with other permanent economic programs.

📌These changes include starting the validity period of language test results from the test report date and excluding real property or investments as proof of settlement funds.

✅The language proficiency requirements state that the applicant must provide an IRCC-approved language test showing a minimum level 4 in the Canadian Language Benchmark (CLB) or the Niveaux de compétence linguistique canadiens (NCLC) for all language skills, and the test results should be less than two years old at the date of application.

📌Regarding settlement funds, applicants living and working in Canada under a valid work permit need not provide evidence of funds. However, other applicants must demonstrate they have sufficient funds for settlement in Canada, which should be available, transferable, unencumbered by debts, and adequate for their initial establishment in Canada. The sufficiency of funds is determined based on the applicant's family size and must be 50% of the current low-income cut-offs for urban areas.
