There are key differences between a record suspension and a waiver for entry into the United States:

- Record Suspensions: A record suspension is a helpful method for those looking to hide their criminal history from Canadian employers or institutions. This suspension will not delete the record but rather conceal it.

- U.S. Entry Waivers: When travelling to the United States, a waiver application is required for individuals with criminal records to request permission to enter the States. A successful application would waive a criminal offence that would otherwise cause the applicant to be denied entry. This application also applies to anyone denied entry at the border for reasons outside criminal misconduct.

Despite being granted a Record Suspension, you still need a U.S. Entry waiver to enter the US with a criminal record. A Record Suspension is not recognized by the U.S. government, as they can still access your criminal history. Obtaining a U.S. Entry Waiver will guarantee your entry into the U.S.

Your NEXUS membership can be revoked for various reasons, i.e. failure to comply with the IRP Act, Customs Act, Criminal Code, or laws or regulations administered by the CBSA.

If your membership has been revoked, your best option is to appeal the decision. Requesting a NEXUS Reconsideration means you believe the revocation was unjust or due to error.

Contact us today to learn about how you can request a NEXUS Reconsideration.

There are many possible reasons as to why you’ve been denied, some of them include: having a Canadian criminal record, failure to verify identity, previously exceeding the permitted six-month stay, suspicions of intending to stay, or suspicions of working overseas without a valid work visa.

If you have not been given a reason by the CBP, contact us today to find out how you can get that information.

As a permanent resident (PR) card holder in Canada, securing citizenship may prove challenging if you have a conviction on your criminal record. The Canadian government places significant emphasis on an individual's adherence to the laws governing the country when evaluating citizenship applications. Holding a criminal record may negatively impact your chances of renewing your PR card, potentially resulting in deportation.

To mitigate these risks, we recommend getting a Pardon (Record Suspension). This process allows individuals to present their case and request that their conviction(s) be set aside, thus appealing to the Canadian government to eliminate any limitations associated with the conviction. If approved, the criminal record will be expunged, and applicants will no longer face concerns when pursuing citizenship.

If you have any more questions, feel free to contact us to learn more.

The decision to allow entry into the United States lies within the discretion of the U.S. Customs and Border Patrol officers. Generally, Canadian citizens with a valid Canadian passport should not encounter difficulties when entering the United States.

Nonetheless, if an officer harbors doubts regarding your reasons for entry, you may be denied entry at that time and required to submit a U.S. Entry Waiver Application.

Potential grounds for denial include:
- Verification of identification
- Exceeding the permitted six-month stay
- Suspicions of working overseas without a valid work visa

If you are unsure that this is the right course of action for you, feel free to reach out to us with any inquiries.
