Navigating the process of making a refugee claim in Canada involves understanding key steps and eligibility criteria. Whether you're arriving at a port of entry or already in Canada, you have the option to make a refugee claim. Eligibility is determined by CBSA or IRCC officials based on various factors such as criminal history, previous claims in Canada or other countries, and existing protection elsewhere. If eligible, individuals are referred to the Immigration and Refugee Board for a hearing.
It's important to note that refugee claimants, who seek asylum within Canada, differ from resettled refugees who undergo screenings abroad. While both groups contribute to the rich fabric of Canada, those making claims within the country are not taking the place of refugees arriving through resettlement or other immigration streams.
Refugee claimants are different from resettled refugees. Asylum seekers make a refugee claim in Canada at a port of entry or online. These claims are governed in part by international treaties that Canada has promised to uphold. Resettled refugees, on the other hand, are screened abroad and undergo security and health screenings (e.g. immigration medical exam) prior to being issued a visa to come to Canada. When they arrive in Canada, they are permanent residents.
As refugee claimants and resettled refugees come to Canada through different immigration streams, those who are claiming asylum upon arrival in Canada are not taking the place of refugees who are coming to Canada from abroad for resettlement, nor those arriving through other immigration streams included in the departmentβs annual Levels Plan.
