🚀 Big News for Start-Up Visa (SUV) Applicants! Work permits can now be applied for with an expired Letter of Support (LoS) 🚀

IRCC updated the program delivery instructions today regarding Letter of Support! Since October 3, 2024, essential applicants under the Start-Up Visa (SUV) program are eligible for open work permits, providing greater flexibility while awaiting permanent residence, however the instructions included a valid letter of support. This changed today!!

✅ Work permits can now be applied for with an expired Letter of Support (LoS).

This update removes a significant hurdle for entrepreneurs navigating the SUV process, offering more time and flexibility while establishing their innovative businesses in Canada.

A few years ago…

A case officer called me about a work visa application, saying he wasn’t satisfied with my client’s work experience because we had only provided tax returns. But my client had been working in the same role, with the same employer, on a valid work visa for three years.

So, I asked the officer what additional proof he needed. His response? “Just write down the dates and positions on plain paper and send it over—I’m confused.”

I pointed out that all the details were already in the application form.

Next, he asked for all employment agreements. Again, I told him, they were already uploaded.

“Oh, I’m sorry.”

Ten minutes later, he calls back. “I don’t think your client meets the Labour Market Test because the job ad was listed in January.”

I open the file. “No, it was posted in June, not January.”

“Oh, I’m sorry.”

Then, he claims there’s no proof the employer contacted the two local candidates who applied. I walk him through the documents—ten pages of emails, texts, and records of back-and-forth conversations.

And then, the kicker:

“Oh… the evidence is at the end of the file.”

After all this, he still said my client would receive a Procedural Fairness Letter (PFL) because he wasn’t satisfied the job met the requirements.

This is why you need a professional.

To address delays in passing Bill C-71, the Canadian government has approved an interim measure allowing certain individuals affected by the first-generation limit to apply for discretionary citizenship grants under subsection 5(4) of the Citizenship Act.

🔹 Who’s Eligible?
✅ Children born or adopted before Dec 19, 2023, impacted by the first-generation limit
✅ Children born/adopted on or after Dec 19, 2023, if their Canadian parent had at least 1,095 days of physical presence in Canada
✅ Individuals born before April 1, 1949, still affected by the limit
✅ Those who lost citizenship due to unmet retention requirements under the former section 8
