President – elect Trump has stated that he will charge tariffs of 25% on all imported goods coming into the US from Canada (and Mexico)
unless they reduce the numbers of persons illegally entering the US.

This matter shows how the US President-Elect can impose his will on immigration matters by using economic ultimatums to give force and effect to his platform.

Canada is already acting on that perceived threat as the Minister of Immigration announced that Canada will be tightening the rules on who can and who cannot file for refugee/asylum status. The Canada Border Services Agency will likely follow up by detaining and deporting many people without status in this country.

This matter concerns the issue of reducing inland applications for asylum and refugee applicants and not those made at legal border crossings or airports.

There has been a massive increase in refugee claims in recent months by many students and this has pushed waiting times to have a hearing to 44 months.

This is unfair to genuine applicants as the test of credibility for non genuine applicants will result in a large number of refusals at the IRB.

As for the Minister’s comments that becoming a permanent resident and a citizen is not a right, he is technically correct. However, under the current

Regulations there is still a right to apply for permanent residence and a right to apply for citizenship as long as a person meets the criteria.

How the Minister will take those rights away is yet to be seen, and would likely be the subject of a lawsuit(s) brought against his Ministry via the Federal Court of Canada.
