❓ Câu hỏi 2 – Work Permit

WEEK 1 - QUESTION & ANSWER
IMMIGRATION & FAMILY SPONSORSHIP
⸻
❓ Question 1 – Spousal Sponsorship
I am a Canadian citizen and I married my wife in Vietnam in March 2025. We dated for approximately 8 months before getting married. Currently, we only have photos, chat history, flight tickets, and our marriage certificate as evidence of our relationship. My wife’s Canadian visitor visa application was refused in 2024.
I am concerned that our sponsorship application may be questioned because we have not been together for a very long time. Should I submit the application now, or should I prepare additional evidence first?
KT Law Firm Answer
A shorter dating period or a previous visitor visa refusal does not automatically mean that a spousal sponsorship application will be refused.
The key consideration is demonstrating that the relationship is genuine and not entered into primarily for immigration purposes.
In your situation, in addition to photos, messages, and the marriage certificate, you may consider preparing additional supporting evidence, such as:
* Communication history between spouses;
* Evidence of visits and time spent together;
* Future plans as a couple;
* Financial support or shared responsibilities (if applicable);
* Letters from family members or friends;
* Other documents showing the development and authenticity of the relationship.
A well-prepared application with consistent supporting evidence can help reduce concerns and the possibility of additional requests from immigration authorities.
⸻
❓ Question 2 – Closed Work Permit
I am currently working as a Cook in Ontario under a Closed Work Permit, which is valid until February 2027. Recently, I received a job offer from another restaurant with a higher salary. Can I leave my current employer and start working for the new employer immediately, or do I need to complete any procedures first?
KT Law Firm Answer
If you hold a Closed Work Permit, your authorization to work is generally limited to the employer, position, and conditions specified on your work permit.
In most situations, you should not begin working for a new employer before confirming that you have the proper authorization or meet the applicable requirements.
Depending on your circumstances, the new employer may need to obtain an LMIA, or your situation may qualify for an LMIA-exempt pathway. A proper assessment is important before making any changes to your employment.
Making changes without following the correct process may affect your immigration status and future permanent residence plans.
⸻
❓ Question 3 – Express Entry
I am 36 years old, graduated from university in Vietnam, and have an IELTS General score equivalent to CLB 7. I have been working as an accountant in Ontario for almost 2 years. My current CRS score is approximately 452, and I have not received an invitation in recent draws.
Should I continue waiting for Express Entry, or should I explore provincial nomination programs (PNP)?
KT Law Firm Answer
For your profile, it is important not to focus only on the CRS score.
A complete assessment should also consider:
* Your occupation and work experience;
* Your current province of residence;
* Your eligibility for provincial nomination programs;
* Your potential to improve language scores;
* Other factors that may increase your competitiveness.
In many cases, pursuing Express Entry while also exploring suitable PNP opportunities can provide additional pathways toward permanent residence instead of relying on only one option.
⸻
❓ Question 4 – Visitor Visa
My parents are 67 and 70 years old and currently live in Vietnam. Our family would like to invite them to Canada for approximately 5 months to visit their newborn grandchild. They receive retirement income but do not have significant assets under their names.
Should they apply for a Visitor Visa or a Super Visa?
KT Law Firm Answer
Visitor Visa and Super Visa have different purposes and eligibility requirements.
If your parents intend to stay in Canada for an extended period and meet the requirements related to financial support, medical insurance, and other eligibility criteria, a Super Visa may be an option worth considering.
However, choosing the appropriate application should be based on the family’s specific circumstances, not only the desired length of stay.
A proper assessment can help determine which option may be more suitable.
⸻
❓ Question 5 – Canadian Citizenship
I became a Canadian citizen in 2017. My two children were born in the United States in 2019 and 2022. They are currently U.S. citizens.
I would like to know whether they may qualify for Canadian citizenship through me as their parent, and what documents would be required if they are eligible.
KT Law Firm Answer
Whether children born outside Canada may qualify for Canadian citizenship depends on several factors, including the parent’s citizenship status at the time of the child’s birth and the citizenship rules applicable to that specific situation.
The assessment generally requires reviewing documents such as:
* Proof of the parent’s Canadian citizenship;
* The child’s birth certificate;
* Documents proving the parent-child relationship;
* Other supporting documents required for the application.
KT Law Firm can assist with reviewing your specific circumstances and provide guidance on the appropriate process and documentation.
