Spain levies an annual tax on net wealth, and the autonomous community in which someone resides can materially change the outcome.

Under the state framework, the general tax-free minimum is €700,000 per person, together with a separate exemption of up to €300,000 for a qualifying main residence.

Wealth Tax is assessed individually, so a couple could in principle benefit from combined allowances of up to €2 million only where each person qualifies and their ownership of the home and other assets supports it.

Autonomous communities can set their own allowances, rates and reliefs.
For the 2025 tax year (the latest completed filing year), the published general minimums included €3 million in the Balearic Islands, €1 million in Valencia, €700,000 in Aragón and €500,000 in Catalonia and Extremadura.

Madrid and Andalusia have bonus regimes that can reduce or eliminate regional Wealth Tax for some taxpayers. However, these should not be treated as blanket exemptions, particularly at higher wealth levels where the interaction with the state-level Solidarity Tax on Large Fortunes must be considered.

The state-level Solidarity Tax on Large Fortunes targets individuals with net wealth above €3 million and operates alongside Wealth Tax, with credit generally available for Wealth Tax paid.

Two people with identical net wealth can therefore face different outcomes depending on where they live. The applicable rules should be checked for the relevant tax year and modelled with qualified Spanish tax advice before relocating.

Wills, pensions, investments and tax arrangements that were set up under UK rules do not automatically adjust to where you now live. Over time, that gap can widen without anything obvious going wrong.

These are four areas that are often worth revisiting once you have settled:

>>>Tax residency
Is your current tax residency status clear, and could any UK tax exposure still apply?

>>>Pensions
Have your UK pensions been reviewed since moving abroad, taking into account where you now live, your retirement plans and your longer-term goals?

>>>Investments
Are your existing investments still suited to your country of residence? What works well in the UK is not always treated the same way in countries such as Spain, France or Portugal...

>>>Estate planning
Have your wills and wider estate planning arrangements been reviewed to reflect cross-border factors?

Uncertainty in any of these areas does not necessarily mean something is wrong, but it may be a sign that a review could be worthwhile.

If any of these points feel relevant, a complimentary initial meeting with a qualified adviser can help you understand whether more detailed financial planning may be appropriate.

For British and American families in France, a will prepared in the UK or US may not automatically decide how an estate is divided.

Under EU Succession Regulation 650/2012, known as Brussels IV, people in France can choose the law of their nationality to govern their succession. The choice must be stated in the will. It may offer more freedom over who inherits instead of relying on French forced-heirship rules.

In 2021, France added a compensatory mechanism to Article 913 of its Civil Code. If the chosen foreign law offers no protection for children, qualifying children may be able to claim against assets in France.

This led to complaints to the European Commission. In June 2026, the Commission reported that France had clarified the rule: it should apply only where the foreign law has no child-protection mechanism. English family-provision rules, including claims under the Inheritance (Provision for Family and Dependants) Act 1975, were considered sufficient.

Following those clarifications, the European Commission formally closed the complaints process on 28 July 2026.

This gives comfort for some wills that choose English and Welsh law, but it is not a blanket exemption. The same conclusion should not be assumed for Scottish, Northern Irish or US law.

The outcome depends on nationality, residence, the law selected, the wording of the will, the assets and family circumstances. Brussels IV determines which succession law applies, not how the estate is taxed.

Our advisers help British and American expatriates in France understand how these rules may affect their estate planning and identify where specialist legal or tax advice may be needed.

If you have a UK or US will and live in France, it may be worth reviewing how these rules apply to your estate.

The rules governing overseas pension transfers have changed significantly.

Since 30 October 2024, transfers to Qualifying Recognised Overseas Pension Schemes in the European Economic Area or Gibraltar have no longer benefited from the previous automatic regional exclusion from the 25% Overseas Transfer Charge.

An exclusion may still apply where the member lives in the same country as the receiving QROPS. Separate exclusions exist for certain occupational, overseas public-service and international-organisation schemes, subject to their conditions and the required information being provided.

As at 1 September 2026, HMRC’s notification list contains only one Spanish ROPS, an employment scheme. A Spanish resident considering a personal QROPS in Malta or Gibraltar will therefore generally not meet the same-country condition. If no other exclusion applies, a £400,000 transfer could incur a £100,000 Overseas Transfer Charge.

The Overseas Transfer Allowance does not create a second 25% charge on top of that amount. Where a transfer qualifies for an exclusion but exceeds the member’s available allowance, 25% may instead apply to the excess. A charge can also arise later if the relevant conditions cease to be met during the statutory relevant period.

A transfer between UK-registered pension schemes is not subject to the Overseas Transfer Charge. However, whether an arrangement marketed as an “international SIPP” is suitable depends on its charges, investments, protections, benefits and Spanish tax treatment.

Regulated, personalised pension-transfer advice is essential before taking action.

For Americans living in France, investing can be difficult because US and European rules often point in opposite directions.

US citizens generally remain subject to US tax on worldwide income, and France also taxes its residents on worldwide income. The US-France tax treaty and foreign tax credits can reduce double taxation, but the result depends on the income and accounts involved.

Under US tax rules, many non-US pooled investment funds may be classified as Passive Foreign Investment Companies, or PFICs. This may include French SICAVs and FCPs, together with European UCITS ETFs.

PFIC status can result in complex US tax treatment, potential interest charges and additional reporting, including IRS Form 8621. Alternative elections may improve the treatment, but strict conditions apply and fund providers may not supply the necessary information.

US-domiciled funds create a different problem. EU PRIIPs rules require a Key Information Document before an investment product can be offered to retail investors. Many US fund managers do not produce one, so European brokers commonly restrict access for clients living in France.

As a result, popular French arrangements such as Assurance Vie, PEA and PER may create US tax and reporting consequences. Meanwhile, US ETFs and mutual funds may be unavailable through European retail platforms.

Possible approaches may include suitable individual shares and bonds or a carefully structured cross-border portfolio. The right approach depends on portfolio size, income needs, existing accounts, tax history and long-term plans.

Our advisers help American expatriates in France understand these overlapping rules, review their investments and identify where specialist US or French tax advice may be needed.

Malta continues to be considered by internationally mobile individuals and retirees, and its special tax framework is changing from 1 January 2027.

Under the new Individual Tax Programme Rules, four special tax statuses will sit within one consolidated framework, with revised minimum tax liabilities, qualifying property thresholds, application fees and five-year status periods.

For the principal residence statuses, the familiar 15% tax rate on qualifying foreign-source income remitted to Malta remains available, subject to the relevant conditions. Different treatment applies to certain income under the UN Pensioner Status.

Naturally, the first question many people will have is: what does this actually mean for me?

The answer depends on your individual circumstances, including your nationality, income sources, residence position, property plans, whether you already hold or are applying for special tax status, and your wider financial objectives.

That is why the rules should be considered as part of a broader financial-planning picture rather than in isolation.

If you would value greater clarity, a qualified Chase Buchanan adviser can help you review the financial-planning implications and identify where specialist tax or legal advice may also be needed.

11/09/2026

The UK treatment of unused pension wealth will change from 6 April 2027.

Finance Act 2026 brings most unused pension funds and pension death benefits into the value of a deceased member’s estate for UK Inheritance Tax purposes for deaths on or after that date.

Defined contribution pensions, including SIPPs, have generally sat outside the estate under current rules. From April 2027, their value may contribute to any IHT due, subject to the estate’s available exemptions and reliefs.

Where the member dies aged 75 or over, pension death benefits may also be taxable as income. This is not simply a 40% IHT charge followed by income tax on the same gross amount: UK legislation provides for taxable pension income to be reduced by the IHT borne.

For a beneficiary resident in Spain, the final position will also depend on Spanish tax law, the treaty position and how the benefits are taken.

Living in Spain does not, by itself, take most unused funds held in a UK-established registered pension scheme outside the scope of UK IHT.

With April 2027 approaching, now is a sensible time to review the position. Regulated financial advice should be coordinated with qualified UK and Spanish tax and legal advice.

Living abroad can change how your pensions, tax position and investments work together. For British expatriates, three areas are especially worth reviewing:

*Whether UK pensions still support retirement plans overseas

*How tax residency is determined across the UK and country of residence

*Whether investment arrangements remain suitable and tax-efficient locally

What worked well in the UK may not remain appropriate after a move abroad. A regular cross-border financial review can help identify issues before they become costly.

Every case is different.

08/09/2026

Moving abroad does not necessarily end UK Inheritance Tax exposure immediately.

Since 6 April 2025, exposure to UK IHT on overseas assets has been based on long-term UK residence rather than domicile. Broadly, an individual is a long-term UK resident if they have been UK resident for at least 10 of the previous 20 tax years.

After someone leaves the UK, that status can continue during a “tail”. The tail is not always ten years: it generally ranges from three to ten consecutive tax years, depending on the individual’s UK-residence history. Someone resident in the UK for 10 to 13 of the previous 20 years will generally have a three-year tail, while someone resident for all 20 years can have a ten-year tail.

During that period, overseas assets may remain within the UK IHT rules. Where tax arises, the standard death rate is 40% of the taxable amount after applicable exemptions, nil-rate bands and reliefs.

Once long-term UK residence ends, overseas assets may move outside the UK net, but UK-situs assets remain within scope. From April 2027, most unused pension property held in UK-established registered pension schemes may also remain within scope, subject to exemptions and reliefs.

Anyone moving from the UK to Spain should review their residence timeline and assets using coordinated UK and Spanish tax, legal and regulated financial advice.

07/09/2026

For British expatriates in France, healthcare status can affect more than medical care. It may also change the tax paid on investment income.

Under France’s 2026 rules, the standard flat tax on dividends, bank interest and many share gains increased from 30% to 31.4%. This combines 12.8% income tax with 18.6% social charges.

Where the relevant social-security exemption applies, including for certain French residents covered by a UK-issued S1, CSG and CRDS may not apply to certain investment income. The 7.5% solidarity contribution may apply instead, potentially reducing the combined rate from 31.4% to 20.3%.

S1 status may also affect social charges on foreign pensions, rental income, property gains and taxable Assurance Vie withdrawals. However, different income and savings products can follow different rules. For example, the standard social-charge rate for Assurance Vie and certain savings products remains 17.2%.

An S1 is not granted simply because someone previously paid UK National Insurance. Eligibility may arise through the UK State Pension, certain benefits, or recognised posted or frontier-worker status.

The final outcome depends on S1 eligibility, income sources, investments, household circumstances and any UK tax that may also apply.

Our advisers help British expatriates in France understand the financial-planning implications and identify where specialist tax advice may be needed.

Could your S1 status affect the tax you pay on investments?
