Are you planning on renting your property to cash in on the tourist trade? Did you know you need a license?

Obtaining a tourist license has now been mandatory for a few years in the Valencian Community for anyone wishing to rent out a property short term. Without this important number, you won’t be able to rent your apartment or house in Spain on platforms such as Airbnb or Booking.com as both yourself and these companies would be exposed to strong penalties.

Obtaining a tourist license is the act of registering your property in the tourism office of your municipality. This allows the municipality to better control the taxes of the short term rental market and to avoid massive investments from abroad forcing locals to leave the city.

720- Tick Tock! ⏰ The deadline for declaring foreign assets is March 31st. If you live more than half the year in Spain, you will be considered tax resident in Spain for all your global income.

If you still have bank accounts or own property in your country of origin you will need to declare these assets in Spain, even if this does not mean you have to pay taxes based on these assets.

The Modelo 720 is highly controversial due to heavy fines if you do not declare the assets. It is very important not to miss the Modelo 720 even if it does not mean you have to pay extra taxes.

The aim of the Modelo is to encounter any non disclosed assets or income which might be considered taxable in Spain. Just remember to file between January 1st and March 31st of the year following the one your information relates to. And hey, if you’re not sure whether you need to file or not, just give me a shout.

Don’t let the Tax man trip you up! Here’s who will need to complete a model 210.

1-Those individuals, both natural and legal, who, even without residing in Spain, obtain income here and do not pay the income tax—for example, those who own real estate in Spain and earn income by renting it. Also those who own a real estate in Spain and don’t rent it.

2-A natural person who resides for reasons of work in Spanish territory, but has nationality of another country, such as a diplomat or official of another country.

3-Those entities who are in a special tax regime of income attribution in a foreign country.

Modelo 720? Does it apply to you?

Modelo 720? It’s a form you have fill out if you’ve got assets and rights located abroad. But don’t worry, it’s not as scary as it sounds. The form is split into three different groups of assets and there are exemptions if the total value of your assets in each group is under 50,000 euros.

So who has to file Form 720? Well, if you’re a resident in Spain, have a permanent establishment in Spain, or fall under article 35.4 of Law 58/2003, then you’re required to file. And it’s the person who holds, represents, or benefits from these assets who’s responsible for reporting them.

The good news is that if you’ve filed before and there hasn’t been a big increase in your assets, you don’t have to file for everything again. You only need to report the groups where there’s been an increase of more than 20,000 euros.

Just remember to file between January 1st and March 31st of the year following the one your information relates to. And hey, if you’re not sure whether you need to file or not, just give me a shout.

Did you take out a mortgage in Spain and you were made to pay the origination fees? According to the Supreme Court, consumers can claim the mortgage expenses they paid for the formalisation of the mortgage as abusive and null and void.

The expenses you may get back: half of the notary expenses and probably all of the land registry, gestoría from the bak and valuation cost.

Don’t leave it for later and contact us at DDC. Although the deadline for claiming these expenses expired in principle on 23 January 2024, 5 years after the Supreme Court declared the clause abusive, the suspension of the procedural deadlines during the state of alarm means that the deadline is extended by a further 82 days: claim before 14 April 2024.

¿Hiciste una hipoteca en España y te hicieron pagar a tí los gastos de formalización? Según establece el Tribunal Supremo, los consumidores pueden reclamar los gastos hipotecarios que pagaron por la formalización de la hipoteca por abusivos y nulos.
Los gastos que puedes recuperar son: la mitad de los gastos notariales y probablemente la totalidad de los gastos del registro de la propiedad, gestoría y tasación.
No lo dejes para más adelante y ponte en contacto con nosotros en DDC. Aunque el plazo para reclamar estos gastos vencía en principio el 23 de enero de 2024, cuando se cumplieron los 5 años de la declaración de abusividad de la cláusula por parte del Supremo, la suspensión de los plazos procesales durante el estado de alarma hace que el plazo se dilate en 82 días más: reclama antes del 14 de abril de 2024.
