BREXIT UPDATE FOR NON RESIDENTS
There are being many changes since last update so will try to resume main points.
Due to Covid nowadays you need appointments to solve nearly everything so it’s better to check before going to the town hall, water boards, etcetera, if you are coming to Spain. I remember that it’s always good to have the DIGITAL CERTIFICATE to solve things with the administrations or online you can do so getting an appointment for certificado digital at your town hall website and going with your passport and your NIE or residencia, they will give you some codes that if you picture then to me I can download the file to communicate with the government at your name (very useful to get letters from the tax agency for example and solve other administration matters), Though you must be very secure with this as having it is as identifying like you with computers. Due to Brexit next year (for this year 2021) NON-RESIDENT TAXES would go up a 5% as it was a hard Brexit and there was no agreement for the economic area neither.
Another change would be that if you are resident in the UK or a non-member state of the Economic Union and you are RENTING YOUR PROPERTY in Spain you cannot discount costs or any deductions like before.
INHERITING OR GIFTING taxes remains the same so far until the end of the year with the exception per person per child of 100,000€ but, if you are thinking of gifting ( or selling) the house to your children is better before the end of the year as the government has announced that from next year, no matter if you are resident or not, the value for taxes for gifting, inheriting or selling would be given by the Land registry of the comunidad autónoma “catastro” and they would have more meanings of setting the highest value, that would be the one used for taxes (market, valuations, comparations, architects informs, etc) .
During a time, it has been necessary for British nationals to obtain the MILITARY PERMITION to buy or to inherit or get a gifting of a house but this has been left aside due to an internal order of the Army saying that only would be necessary in rural areas.
TRAVELLING TO SPAIN now is limited to 180 days in total for UK residents, so that you are not in Spain more than six months and a day in total per year, and in the practice after 90 days you must go and remain another 90 days in the UK before coming back, though if any special reason you can ask for an increase of the period.
Regarding OBTAINING RESIDENCIA now in Spain for British national you have to apply first from the UK for a visa and health insurances would be needed before coming to Spain (we can quote you with us if you require it) and requirements of incomes has increased. The visa would be applied from the nearest Spanish Consulate or embassy to you and afterwards we can go with you to the part of the process here, after you have got the visa. About DRIVING LICENCES for new residents: now to obtain driving licences you must pass an exam and normally would need to go through a driving school so that they help you with it.
BANK CHARGES for reception of transfers from the UK are now 15€ min. or 0.04 so if you are going to pay with a transfer from a British bank account into an Spanish bank account must take this in count and top the transfer so that we get the exact amount. Though if you need to do transfers regularly or a big lump sum speak to us and would give you another solution. I remember the importance of giving to your banks an update of your passports and NIE and of your National Insurance Number in the UK.
Also, now if receiving any certified post or COURIER we have to pay customs and VAT for the customs agent, depending of the value of the post you pay more or less.
I remember that if you are TELE-WORKING IN SPAIN you should pay here income tax.
