Licencia Turistica - Holiday Rental License
Legislation amendments
The Comunidad Valenciana has issued a new decree regarding amendments and additions to the existing law regarding holiday rental licenses (Licencias Turisticas). Decreto Ley 9/2024” of 2 August.
An overview of the main points:
1. Licenses requested from 5 August 2024 must be renewed every 5 years, including the permission of the city council (compatibilidad urbanística) and any approval from the residents' association.
2. Licenses obtained before 1 July 2018 do not need to be renewed (for the time being).
3. Licenses obtained between 2 July 2018 and 4 August 2024 must be renewed in 2030, including the permission of the city council (compatibilidad urbanística) and approval from the residents' association. 4. A name change = application for a new license.
5. Use of a keybox is prohibited. The check-in procedure must be done in person. After checking in, someone must always be available in person for any problems or questions, for example.
6. Renting out part of the home is prohibited (e.g. renting out rooms). The fine can be up to €600,000 = very serious violation.
7. Failure to register tenants correctly = serious violation
8. The rental is managed by third parties? The owner is ultimately responsible for, for example, violations by tenants, rental problems, etc. the intermediary bears no responsibility here.
AI (Artificial Intelligence) is used to combat illegal rental.
Which means that the checks will also become stricter (these checks on illegal rental are carried out by the municipality)
The tourist license will be cancelled/stopped in, among other things, the following cases:
Due to inaccuracies in the registration (e.g. the license is still in the name of the previous owner)
When there is no holiday rental within 2 months after the license has been granted.
If there has been no holiday rental in a period of 1 year.
If a license has not been renewed on time.
You will receive a notification if a license is terminated.
