Artificial intelligence is increasingly a key component of new innovations, but can AI itself be patented?
A mere algorithm or a reference to machine learning is not enough. In patenting, the decisive factor is the technical effect, meaning how the AI concretely improves a technical process or function.
In addition, how the invention is described in the patent application is crucial. A generic mention of “artificial intelligence” is not sufficient. A precise description of the data, the model, and how the solution operates as part of a technical system is required.
