Artificial intelligence is increasingly a key component of new innovations, but can AI itself be patented?

A mere algorithm or a reference to machine learning is not enough. In patenting, the decisive factor is the technical effect, meaning how the AI concretely improves a technical process or function.

In addition, how the invention is described in the patent application is crucial. A generic mention of “artificial intelligence” is not sufficient. A precise description of the data, the model, and how the solution operates as part of a technical system is required.

Today we participated in the Maria 01 Office Hours Fair. Thank you to everyone for meeting us!

Over the weekend, the Berggren team gathered in Laulasmaa for our MIITTI personnel event, a chance to connect, recharge, and look ahead together.

The setting by the Estonian coast created the perfect atmosphere for meaningful conversations, shared experiences, and strengthening the sense of togetherness across teams.

What made the weekend especially memorable was the people, the energy, openness, and shared ambition that define Berggren.

Tekoäly on yhä useammin osa keksintöjä, m***a pelkkä algoritmi ei vielä tee ratkaisusta patentoitavaa. Ratkaisevaa on se, syntyykö tekninen vaikutus ja miten se kytkeytyy kokonaisuuteen.

CJEU: The Market Court’s interpretation in a trade mark case was contrary to EU law

The CJEU confirmed that national courts cannot limit a trade mark proprietor’s rights by applying national legal principles beyond what EU law expressly allows. The decision in Case C-452/24 Lunapark Scandinavia Oy Ltd v Hardeco Finland Oy is particularly relevant for Finnish trade mark practice.
