Today, we proudly celebrate a significant milestone with the Mataqali Duiyata of Namotomoto Village as we officially handed over their first ever Mataqali Trust Deed, following the successful registration process with the assistance of the iTaukei Land Trust Board (TLTB).

We are truly grateful to the Mataqali for trusting our services and allowing us to walk alongside them in turning their vision into reality.

This Trust Deed marks the first major step towards unlocking the commercial potential of their land and creating a business arm for their mataqali. From here, the journey continues as they work towards applying for a commercial lease and establishing a sustainable business venture that can create opportunities and prosperity for their members and future generations.

Legal Procedure for Obtaining a TLTB Lease

1. Identify the Land

A. Identify the land you wish to lease.
B. Confirm whether it is available for leasing and whether there are any existing reservations, disputes, or conflicting interests.
C. TLTB’s Estate Officers will verify this.

2. Submit a Formal Application

* Complete the appropriate TLTB lease application form:
* Residential Lease
* Commercial Lease
* Industrial Lease
* Agricultural Lease
* Commercial Agriculture Lease
* Submit the application together with the prescribed fee and supporting documents.

3. Provide Supporting Documents

For individuals, TLTB generally requires:

* Identification (Passport, Driver’s Licence, FNPF Card, etc.)
* Birth Certificate
* TIN Letter/Card
* Bank Statements
* Proof of income or employment
* Utility bill (for some lease categories)

For companies:

* Certificate of Incorporation
* Company structure/shareholding
* Business Plan
* Financial Statements
* Development concept plans

Commercial and industrial developments usually require detailed business and development proposals.

4. TLTB Assessment and Inspection

TLTB officers:

* Inspect the land.
* Consult affected landowners.
* Determine whether the proposed use complies with planning requirements and TLTB policy.
* Check for conflicting claims or competing applications.

5. Landowner Consultation

The relevant mataqali or landowning unit is consulted regarding the proposed lease. TLTB has a legal obligation to protect landowner interests before approving leases.

6. Lease Offer Issued

If approved:

* TLTB issues a formal Lease Offer.
* The offer sets out:
* Lease term
* Annual rent
* Premium (if applicable)
* Development conditions
* Permitted land use
* Other lease covenants.

7. Payment of Premium and Fees

The applicant pays:

* Lease premium (if required)
* Survey fees (if applicable)
* Registration costs
* Stamp duty (where applicable)
* First year’s rent or other charges.

8. Ex*****on of Lease

* The lessee signs the lease.
* TLTB executes the lease as trustee.
* The lease is then forwarded for stamping and registration.

9. Registration

The lease is registered with the relevant authority, creating a legally enforceable interest in the land. Once registered, the lessee receives the registered lease documents.

Residential Lease

Typical purpose:

* Building a family home.
* Residential occupation.

Generally, you must:

* Show financial capacity to build.
* Comply with municipal or rural planning requirements.
* Develop within the period specified in the lease conditions.

Commercial Lease

Typical uses:

* Shops
* Offices
* Service stations
* Retail developments
* Commercial complexes

Additional requirements:

* Business plan.
* Development concept plan.
* Company documents (if a company).
* Compliance with town planning requirements.

Industrial Lease

Typical uses:

* Factories
* Warehouses
* Manufacturing
* Processing plants

Additional requirements:

* Feasibility studies.
* Environmental approvals (where necessary).
* Industrial development plans.
* Compliance with zoning and planning laws.

Important Legal Point

A person does not obtain a legal lease merely because landowners verbally agree. The lease becomes legally effective only after:

1. TLTB approval,
2. Ex*****on of the lease documents,
3. Registration of the lease.
