🌐 Intellectual property is an increasing challenge in today’s fast-paced digital marketplace. Whether it’s stolen designs, copied branding, or unauthorised use of trade marks, businesses of all sizes are at risk of theft 🔒

⚖️ Case in point: Shein vs. Temu

Recently, Shein, a leading Chinese fast fashion giant, filed a lawsuit against Temu, a US-based online marketplace, accusing them of serious infringement 🔍 The allegations include design theft, trade mark violations, and social media impersonation. This legal battle isn’t their first - both companies have been already involved in multiple lawsuits.

🌍 This is where Geographical Indications ( ) come in - an intellectual property right that links products to their origin, safeguarding the reputation of distinctive regional goods while supporting local producers 🏞️

Can you imagine being the organizer of a globally renowned event and facing the threat of not being able to use the name of your event?

Well, this almost happened to the International Olympic Committee.

🏅 With the Paris 2024 Olympic Games just beginning, it’s a perfect time to reflect on an interesting case that occurred before the 2000 Olympic Games in Sydney.

What sets the International Olympics Committee (IOC) apart in IP protection is its proactive and comprehensive approach. However, the IOC didn’t take such extreme measures until a third party tried to register trademarks for all candidate cities for the Millennium Games (including Sydney 2000). 🚫 Fortunately, the IOC resolved the issue and consequently began safeguarding its City and Year word marks, ensuring their branding is protected well before a host city is even announced. 🛡️

Typically, trademarks combining a city and year, like „Paris 2024”, lack uniqueness. However, due to the global attention and media coverage of the Olympics, international trademark offices recognize its distinctiveness upon the announcement of the host city and grant the protection of the mark. 🌐📺

The IOC’s branding has evolved since the first modern Olympics in Athens in 1896. The iconic Olympic rings were introduced in 1913. 🌟 The IOC also benefits from international agreements like the Nairobi Treaty on the Protection of the Olympic Symbol (1981), which obliges member countries to protect the Olympic symbol. This multi-layered protection strategy highlights the IOC’s commitment to preserving its brand’s integrity. 🔒✨

🏆 Did you know UEFA registers logos well in advance? This year’s UEFA EURO 2024 championship logo was registered back in 2022. UEFA has also already secured logos for EURO 2028 (UK & Ireland) and EURO 2032 (Italy & Türkiye).

UEFA protects a wide range of intellectual property, including words, phrases, emblems, and logos associated with each . For this edition, they’ve protected phrases like “EURO 2024” and “UNITED BY FOOTBALL. VEREINT IM HERZEN EUROPAS” the official logo, emblem, trophy, and even the mascot 🐻 Beyond trade marks, UEFA also secures copyrights and registered design rights in certain territories for stadium pictograms and pattern palette branding.

But UEFA isn’t the only one safeguarding their in the football world 🥅 Top players like Kylian Mbappé, Xavi Simons and Erling Haaland have all registered their names as trade marks.

🥇 What’s the lesson here? The best in the industry understand the importance of IP protection. We should all take note and learn from the pros.

🛸 Did you know that today is World UFO Day? Theoretically, let’s say that extraterrestrial life exists: what would happen to their inventions? 🤔

🪐 For now, there is no interest in creating an Intellectual Property Office for the Solar System. According to the Outer Space Treaty, outer space and celestial bodies are considered res communes and should be used for peaceful purposes. Additionally, a State party to the treaty retains jurisdiction and control over its space-entered objects. In theory, this could open the door to total domination by the human race over patents in the space sphere.

Unfortunately, law currently closes off the possibility of registering IP rights to non-humans 👽

💭 What do Lionel Messi, Taylor Swift and Cara Delevingne have in common? Apart from their popularity, they each have their name registered as a trade mark.

But what if your name happens to be the same as a very famous ? 🤔

🚘 The Italian Patent and Trademark Office (Italian Patent and Trademark Office) has issued a decision in the dispute between Elettra Lamborghini and Automobili Lamborghini. Elettra Lamborghini, a famous singer and granddaughter of Lamborghini founder Ferruccio Lamborghini, applied for the word mark “Elettra Lamborghini” in 2019. Automobili Lamborghini opposed the trade mark on the grounds of likelihood of confusion.

🎙️ The decision was ruled in favour of Elettra and was based on Elettra’s strong reputation in the entertainment industry and her aim to use her name for commercial purposes. They stated that the use of “Elettra Lamborghini” would not take unfair advantage of the distinctiveness or reputation of Automobili Lamborghini’s mark.

The case shows that there is still a lot to be established regarding registration of one’s own name. However, the authorities tend to favour celebrities in disputes, making it easier for famous individuals to secure trade mark rights over their names ⚖️
