Good documentation is essential, but documentation alone won't secure a positive inspection outcome.

The CQC isn't just looking at what's written down, they're looking at what happens in practice.

🚨 Major update for health and social care providers 🚨

The Supreme Court has overruled the long-standing Cheshire West “acid test”, changing how deprivation of liberty may be assessed for people who lack capacity to make decisions about their care and living arrangements.

This could have important implications for care homes, supported living and domiciliary care services.

Providers should continue following existing DoLS and Court of Protection processes for now, but should start reviewing MCA policies, care plans, restrictive practice records, risk assessments and staff training.

📢 CQC Assessment Framework Update

The Care Quality Commission (CQC) has announced that between June and October 2026, it will be piloting and testing its new assessment methodology, with a final evaluation planned for November 2026.

These pilot assessments will run alongside existing inspections and involve a voluntary sample of providers representing the diversity of the sectors CQC regulates. The aim is to test how the new approach works in practice and gather feedback from providers, inspection teams, and wider stakeholders.

This development forms part of CQC's commitment to restoring credible, consistent regulation that supports service improvement and provides assurance that people are receiving safe, high-quality care.

Providers should be aware that there will be further opportunities to contribute to the development of the new assessment approach, and CQC is currently encouraging feedback on its draft sector assessment frameworks via its online survey, which remains open until 12 June.
