📉 The gender pay gap has been declining slowly over time. Over the last decade, it has fallen by approximately a quarter among full-time employees.*

🧑‍🦳There remains a large difference in the gender pay gap between employees aged 40 years and over and those aged under 40 years.*

📉The gender pay gap has decreased across all major occupational groups between 2022 and 2023.*

🥀The gender pay gap among full-time employees is higher in every English region than in Wales, Scotland, or Northern Ireland.

📅 On 26th October 2024, employers will be obliged to take ‘reasonable steps’ to protect workers from harassment of a sexual nature (‘sexual harassment’).

📝 Draft guidance from the Equality & Human Rights Commission (‘EHRC’) illustrates the new preventative duty to anticipate scenarios that may give rise to sexual harassment and take reasonable pro-active steps to address them (i.e. risk assess & act). This extends to preventing sexual harassment of workers by third parties.

🚨 On 26th October 2024, employers will be obliged to take ‘reasonable steps’ to protect workers from harassment of a sexual nature (‘sexual harassment’).

Draft guidance from the Equality & Human Rights Commission (‘EHRC’) illustrates what the new preventative duty will require in practice:

🔍 Employers should anticipate scenarios which may give rise to sexual harassment and take reasonable pro-active steps to address them (i.e. risk assess & act).

🛡️ This extends to preventing sexual harassment of workers by third parties.

❓ Have you done enough to comply with the new duty?

🚫 If not, the EHRC may take enforcement action against you.

💸 Tribunals may uplift compensation for sexual harassment by 25%.

Recent Case Law has highlighted the importance of early consultation during a redundancy process. Two cases in particular are:

1️⃣ Joseph de Bank Haycocks v ADP RPO UK Limited
The Employment Appeal Tribunal (EAT) ruled that the Claimant’s dismissal was unfair due to insufficient consultation at the early stages of redundancy. Notably, the EAT emphasized that an appeal cannot correct a lack of consultation during the formative stages.

2️⃣ Valimulla v Al-Khair Foundation
In this case, the EAT overturned a Tribunal's decision, finding the Claimant’s dismissal procedurally unfair. The Claimant, placed in a pool of one despite others holding the same position, had not been consulted on the pool used in the redundancy process. The EAT stressed that consultation must occur when it can still influence the outcome.
