Some of team HRSS completed The Kiltwalk Mighty Stride on Sunday 26th April, taking on the challenge of walking 23 miles from Glasgow Green to Balloch, Loch Lomond, to raise funds for Kilbryde Hospice.

In the recently announced change to the Employment Rights Act 2025, from 6th April 2026, employers become subject to a statutory duty to maintain comprehensive holiday pay records for six years. The change coincides with the launch of the Fair Work Agency (FWA).

Key points of the reform:
➡️Six-year record retention: Employers must keep evidence of all annual leave entitlements and payments for at least six years – even for employees who have left the business.
➡️Evidence of accuracy: Records must show how holiday pay was calculated, especially where variable pay (such as overtime or commission) is included.
➡️Enforcement by the Fair Work Agency: The FWA will have inspection powers, allowing it to request records, investigate breaches, and impose penalties.
➡️Criminal sanctions: Failure to keep adequate records may be considered a criminal offence under the Act – this elevates record keeping from “good practice” to “mandatory compliance.”

In preparation for the change in legislation employers should:
➡️Audit current systems to identify record-keeping gaps.
➡️Ensure systems support six-year retention with adequate detail.
➡️Train teams on what constitutes “adequate” documentation.
